Default Bankruptcy that wasn't.

We filed bankruptcy in 06/2005, our lawyer at the time made a deal with the bankruptcy trustee that we would pay $4000 that we were unaware of. Because we did not pay the money our bankruptcy was revoked. Now we are in limbo and a new bankruptcy lawyer will pick up our case because the trustee is basically a hardball guy that nobody wants to deal with. What can we do?
We now have a judgement for over $4000 and I spoke to the trustee, he said even if its paid the bankruptcy is still revoked.

Do you have a copy of your dismissed bankruptcy filing and all the motions etc?
If not, go to PACER.gov to get a copy of your file just so you know what happened.

I'm not sure what the judgment is about, as you did not specify. What did you file before, Ch 7 or Ch 13? What are you looking to do now - reopen the old bankruptcy or file a new one? If so, then you should probably interview several BK attorney's to obtain one that will work on your behalf. The Trustee works for the creditors, not for you (the debtor). The BK dismissal is a public record. Are you trying to get it off your credit report?

If you are going to file again, check the stickies in this site so you can prepare yourself all about bankruptcy procedures so when you interview various BK attorney's you know if they will fit for you or not. Another site to check out is BKForum.com The more you educate yourself about the process, the more the BK will help you in the long run.

If you are looking to remove the public record of your dismissed bankruptcy from your credit report, then that is a different issue.
