Angry CVF Consumer Acquisitions at it again

I had made a few posts on here back in November/December about CVF consumer acquisitions. I retained a lawyer to handle this and he made some calls to them (and Northland Group who apparently had the account at the same time) and we thought we got them to quit being jerks.

Then, about a month ago these 'fine fellows' decided to start posting to my credit report. They are under (get this) installment accounts. LOL! Installment, eh? I never paid them a dime. I actually have sent them a few letters CMRRR with the last one telling them to quit bugging me and that any further correspondence needs to go through my lawyer. Nothing further has been sent to either myself or my lawyer.

They have posted to my credit report a few times starting in 08/2011 and then twice in January 2012 (each a different report). Since I did send them CMRRR letters disputing the account, here are the remarks with the account:

Remarks:
[TransUnion] Collection Account
Account information disputed by consumer, meets FCRA requirements
[Experian] Customer disputed account - reported by subscriber.
Account seriously past due date/account assigned to attorney, collection agency, or credit grantor's internal collection department.
[Equifax] Consumer disputes this account information
Collection account

Not sure what else to do now. Do I dispute with the credit reporting agencies saying that these guys never sent me any validation (other than them saying they own the account and a fake dollar amount and then that they were 'checking into it')? Or what?

We were thinking of buying a different house this year and just when my credit was getting better (and should have been cleaned up big time in 2012) these jerks are playing games.

Also, from searching the web on these guys, it would seem that they are popping up (in the last 1-2 months) on a lot of other folks' credit reports. Grr.

They have multi addresses (and like to stamp their envelopes with a NIAGRA FALLS zipcode and their return address is either Greenville, SC or some place in Minnesota) and looks like they are a product of Resurgent/Sherman/piece of crap companies.

I guess I'm missing something. I don't see any violation. It shows disputed you said they sent you DV (weak, but DV) and it probably was an installment account they allegedly bought.

The CRA is going to care less if they sent you validation or not. The CRA simply report what they are providing to them. Now if you can prove the information is incorrect, that is a whole other story. However, if you dispute and your dispute is based only on they should not be reporting because they have not followed the proper procedure, the CRA will tell you to take that up with the JDB and/or sue the JDB but it's not our job to determine if you did or did not get proper DV.

I guess my question is why are they posting to my credit report if it wasn't there when I DV'd them (showed up after the fact) and how can they keep posting to it if they reported to the CRA that the account is currently in dispute? I thought they couldn't post to a credit report unless they got a judgement to do so?

Also, if they stop posting to a CR is there finally a period of time that passes that I can dispute with the CRA's since CVF has stopped posting and therefore must mean that it's BS?

Just not sure that's the next step here.

Could you please post their addresses here? I'd like to see if the are a part of the Sherman Companies. Sherman's LVNV branch has offices in Minnesota and in Greenville, SC.

Minnetonka is a posh suburb of the Twin Cities (actually on Lake Minnetonka). Cargill is a major company in Minnesota, primarily in the food business. Sounds like they decided to dabble in the debt collection business too, only they do not want people to know it.

Kinda like the payday loan business. Most of the companies are fronts for the large banks but the large banks will never admit that.

Just as i thought. the name LVNV is taking a beating in the press and online. Here is Resurgents (the collection arm of LVNV and the Sherman Companies) address: Resurgent Contact Page

Correspondence Address

Resurgent Correspondence
PO Box 10497
Greenville, SC 29603
Payment Address

Resurgent Capital Services
PO Box 10466
Greenville, SC 29603
Overnight Payment Address

Resurgent Capital Services
Attn: Payment Processing
15 S. Main St., Suite 700
Greenville, SC 29601

Now we know for sure it is related to Sherman and LVNV.

So, if a food business is dabbling in debt collection but LVNV is fronting it how do I handle getting them off my credit report? Seems as if I got them to quit contacting me via mail (NEVER called me, thank goodness).
