Tricky SOL Question Regarding Money Owed to PRIVATE College

Default Tricky SOL Question Regarding Money Owed to PRIVATE College

**** I copied and pasted my post from the collection forum to here because no one seems to know the answer to this question***

We have a collection agency after my husband for a supposed debt he owes to a private college. I think it is out of SOL but I wanted to see if I could get info since it is due to a school and I know that there are a whole other set of rules regarding that.

1) It is NOT a loan. This is tuition that the college claims is due.

2) It is from a PRIVATE college so it shouldn't be the same as a public school which is backed by the federal government

3) My husband said he believe he attended in either 2003 or 2004 but the collection agency says they have a letter from the college stating he owed money and it's dated 1/2005. They are sending me this info. Even if I go by the 2005 date SOL should have run out in 2009 and it should have to drop from his credit report in 2012.

Any input would be much appreciated.

Tutition accounts from a private non profit schools have no SOL.
