Default Mediation today

Had mediation today, I questioned the mediator on some of the rules, he told me he did not know the rules and they play this game everyday and get away with it. Then he told that the mediation rules I am referring to did not matter here. Then tries to get me to admit I owed them $$$. I told them I owed them ZERO, and prove it! As we were walking to get my copies he told me I was doing it wrong and they will get their money. I complained at the main desk and they were looking at me like deer in headlights! My last words were maybe I need to file a suit!

I am telling you this guy was rude, and was definitely there for Midland. He was in no way impartial what so ever. He was 100% for Midland. Aren't mediators just there to mediation the settlement offers and to be impartial, and to mediate. Something is rotten in Denmark I say.

What do I do?
or better yet How do I do it?

Ignore the mediator for now. He's not the judge or the jury. Learn the rules and learn how to kick Midland's ass. Then kick Midland's ass. If you are feeling especially vindictive, show up with a certified copy of the dismissal with prejudice or the judgment in your favor and rub the mediator's nose in it. Hard.

I am trying, Today I filed a motion to amend my answer in one case, I filed a answer and motion to preclude affidavit in another. This week I will send discovery requests to them for case #1 This is tough but I will make it.

Excellent. Coltfan is the resident JDB destroyer, so you might want to read through all of his posts. MarvinArizona went into an MSJ hearing against Midland knowing very little about the rules of civil procedure and kicked their butts. He's got a video on Youtube of him doing it.

While I know that there are more attorneys on here than just these two, calawyer and nascar are both attorneys, though not in AZ. (I would give credit to the others, but I cannot name them.) They'll both try to avoid giving direct legal advice because they like maintaining their status as licensed attorneys, but if they tell you something about procedure, listen. They may not know you, but they care about people like you. I listened to calawyer once, and it was one of the best decisions I ever made.

Yes I watched Marvin's video, have read just about everything on here. I got confused from that(the reading), and now am focused on the hearsay/lack of standing issues.

I have a degree in physics. I think the judicial system is complex, and believe me, I know complex. It ain't going to be easy and it isn't always going to be intuitive. Look at the docket for the court that your case will be heard at, and go in and watch hearings and trials if you can. Keep the rules that they are doing whatever it is that they are doing in mind.

Yes I planned on doing that ( sitting in on cases) The tough part is getting time off to do it. I am a carpenter and its not like I have many rain days here in the desert. Have 3 years of hardly any work to make up for, so taking a day off is just not a option right now unless I seriously have to.
