SOL Question

Default SOL Question

Hello- A certain collection agency sent me a settlement offer for a Tmobile account and the last activity on the account was from 2005. I sent them a zombie debt letter and they responded in the mail with a 1 page copy from Tmobile of a statement! on the statement it says the amount is due by 12/2005! That's all they provided and said that this is validation for the above account.

Since this is out of SOL and they completely ignored my letter stating that I would sue them for Zombie debt reporting. Does this mean it's a green light to sue?

This is all new to me so I want to make sure I am doing everything right!

When was the last time you paid on the account? Negative entries remain on your credit report for 7 to 7.5 years after the date of your last payment. The SOL for collection and the SOL for reporting are 2 different SOLs.

There has been no activity since 7/2004...

OR has a six year SOL. If you have not paid on it since 04, then you should be in the clear. Just don't promise to pay or make any kind of payment on it.

As Tom said, it's probably outside the SOL. Just check your state laws to make sure.
