    • I received post-judgment discovery today. When I was reading it, I noticed that the judgment date is wrong under section of definitions.I was wondering if I could use it to deny all or some questions in the discovery.
    • I appreciate this more than you know, but, and I hate to sound ignorant, I have no idea what any of that means. It's all just words swirling around my mind. Am I doomed?!
    • Synchrony has an arbitration provision. https://www.creditinfocenter.com/community/topic/329436-arbitration-overview-and-strategy-2018-most-up-to-date-info/
    • I came across this forum looking for anything I could to help me out. I've never been sued, and I almost certainly can't afford an attorney. I've had ridiculous anxiety ever since getting served last week. If anyone can help me out, I would appreciate it more than you would know. I saw some format on a couple different threads, so I'll use it below. If I make any mistakes, please let me know, and I will be more than happy to correct them. 1. Who is the named plaintiff in the suit? Portfolio Recovery Associates, LLC 2. What is the name of the law firm handling the suit? (should be listed at the top of the complaint.) Brandi Marie Addison , 15660 N. Dallas PKWY, STE 350, Dallas TX 75248 3. How much are you being sued for? $2,794.68 4. Who is the original creditor? (if not the Plaintiff) Synchrony Bank 5. How do you know you are being sued? (You were served, right?) Served in person 6. How were you served? (Mail, In person, Notice on door) Served in person 7. Was the service legal as required by your state? Yes, served by person 8. What was your correspondence (if any) with the people suing you before you think you were being sued? I have never spoken to PRA LLC 9. What state and county do you live in? Gregg County, TX 10. When is the last time you paid on this account? (looking to establish if you are outside of the statute of limitations) August 21, 2019 according to the petition 11. What is the SOL on the debt? To find out: 4 years  12. What is the status of your case? Suit served? Motions filed? You can find this by a) calling the court or  looking it up online (many states have this information posted - when you find the online court site, search by case number or your name). I have look by name, by the plaintiffs attorney, by my name, court number, case number and everything I can think of on the Gregg County website and I can not find any information on my case. My case was "citation is issued pursuant to a petition filed by the above name plaintiff on 10th day of February, 2021" filed in the justice court pct 1 Gregg County, TX under Judge B. H. Jameson. I was served with the papers February 24th and it says I have until the 14th day after the day I was served to file my answer. 13. Have you disputed the debt with the credit bureaus (both the original creditor and the collection agency?) No have never had contact 14. Did you request debt validation before the suit was filed? Note: if you haven't sent a debt validation request, don't bother doing this now - it's too late. No have never had contact 15. How long do you have to respond to the suit? (This should be in your paperwork). If you don't respond to the lawsuit notice you will lose automatically. In 99% of the cases, they will require you to answer the summons, and each point they are claiming. We need to know what the "charges" are. Please post what they are claiming. Did you receive an interrogatory (questionnaire) regarding the lawsuit? Received February 24, 2021 14 days (March 10th, 2021) 16. What evidence did they send with the summons? An affidavit? Statements from the OC? Contract? List anything else they attached as exhibits. I don't see any sort of evidence in the paperwork. It just looks to be a petition.   Thank you in advance for any help!
