HOLY CRAP!!!! I haven't even submitted my MIL or my TB yet!!! I called the clerk and she confirmed Plaintiff filed for a dismissal. Gotta go pick up the proof tomorrow during my lunch!!! Wooohooooo!!!! Halleluia! I have a MIL and TB and Declarations ready to fly. All dressed up and nowhere to go! Thanks to Seadragon, Helpme, Calawyer and EVERYONE for support and kudos! I need to black out confidential info and post these excellent documents for everyone to use. Let's tear it up peeps!!! Let's spread the love and help and support. @BV80 I only needed to disclose my defenses and legal theory and it isn't a big deal. My answer had the most important item in it already which is that they must produce the contract between the parties to prove breach of contract. No contract produced during discovery and no disclosure means they can no longer introduce it, hence their case is defective.

I can't answer the other stuff, but I did a power of attorney where my father signed over and gave me POA for all legal proceedings. I was then able to act in his behalf on a court case. Check your rules of civil procedure to see if Wyoming allows that. or call the court, the clerk may know.

Get that notice out ASAP. The sooner you can get the clock ticking the better at this point.

Yes, my understanding is, that since we are WAY past 30 days of them bringing suit, that I then file my notice that they have failed to post the cost bond according to the statute. I'll wait my 20 days and check to see if it gets filed. It either won't or it will but I am almost certain the attorney will sign for the bond herself which is a no no (she'll probably assume I don't know this) and I'll then motion to have the case dismissed. If the judge lets them get away with it, i'll have a reason to appeal at least.

The collection agency is still reporting? I would write them and send them a copy of dismissal and tell them to remove the collection immediately or you will sue.
