I have a couple questions I hope someone will be able to answer to get us started correctly. Where on their website do we initiate such?   4. Greetings all, Just a simple question at hand here to make sure I am thinking things right. This suit over an alleged debt first happened a little under a year ago and was dropped by the lawyer at the time for Midland funding under their consumer bill of rights for hardship. The lawyer at the time said not to worry about it unless something definitely changes in your life. Nothing has changed, in fact the only thing that has changed is my health deteriorating. Lo and behold, not even a year passed and another law firm for the same stated JDB is suing us again over the same alleged debt.

  6. (Assuming debt is not past SOL...) Is it legal to sue for the same case in less than a year's time (a few days short of 1 year)? I am being sued by the same JDB for the same case that was dismissed without prejudice last year. This time it's being handled by a new law firm. Could someone please guide me? Any help is greatly appreciated. Thank you!

  8. It was for hardship. It may be past SOL but it was because of hardship from the other law firm. Is there anything we should include in our affirmative defenses? Should we follow the same defenses as we did from the first one?
  9. Greetings Everyone, It seems the same suit as the one a few days short of 1 year ago which was dismissed without prejudice is coming to haunt me again. It's from the same jdb - Midland Funding, but a different law firm this time. What should we do... handle this as if nothing has happened and this is a first time law suit - answer it and wait to see what information they send us if it is the same or not? Is my response in Number 9 correct and should I strike the affidavit, etc. or do anything before pre-trial while giving this answer? I understand the answers we send to them the judge actually does not see until later or not at all so should I even mention this conflict?   12. Hello everyone, Here's an update to my case --- so I'm back to ask for more help. I sent my discovery to the plaintiff 30 days ago and they did not respond. Instead, they sent me their RFA and some photocopied documents: bill of sale, affidavit from OC, etc. I attached their RFA, photocopied documents they sent along with it (**Not included in the attached file** is 1 page photocopy of an account statement with my name and address.), I also attached my answers to RFA -- which I need help on. Please check my answers as I am not sure and please help me answer also those that are still unans
