  1. I spoke to an attorney who said that after the cost of selling the home ( 7%) there would not be enough equity to pay the $100K exemption. I am in the process of filing Chapter 7 and will update you guys how things go. Thank you all for your input.
  2. I am a single parent with 2 dependents. I have about $115,000 in home equity. What are the chances of the Trustee selling my home in this situation? Even if the I get some money as part of my exemption I won't qualify for a new home. If I can get a friend or relative to finance a mortgage loan under their name would I be able to use that money as down payment and as long as I am on the Title and live in the home would that justify my exemption to be valid and not be taken back by the Trustee?
  3. I am filing for bankruptcy. My credit card debts incurred after we got married but we do not have any joint accounts. How will my bankruptcy effect my spouse's bank account and assets that's only in his name? Also, including my husband's income could I still qualify for Chapter 7? His income is high however, he also has alot of expenses on his own. Incase I only qualify for a Chapter 13, will our gross or net income be used to calculate my monthly payment? And what can we not deduct as expenses? Federal taxes and other taxes takes a big chunk out of our paychecks.

  5. I received from Manadrach Law Group (for CACH, LLC) Request for Admissions, Special Interrogatories, and Request For Production Of Documents in the mail on 1/19/16. I just sent out my responses this morning (2/18/16) and was wondering if I responded timely. Do I get 35 days since I received the request in the mail, and what day should I start to count (day of the POS in the package or the day I received the package) and what day is the deadline for me to send my responses (postmarked date of when I sent my responses or the day the plaintiff receives my responses?)? Can someone please clarify this for me please. Thank you.
  6. I received from the Plaintiff, Mandarich Law Group for CACH, LLC the Request for Admissions, Special Interrogatories, and Request For Production Of Documents. Is there a template I can use to respond to the Request for Admissions, Special Interrogatories, and Request For Production Of Documents? The questions I received are the same questions I saw in this forum: Should I use the template from this? http://saclaw.org/wp-content/uploads/sbs-discovery-responding-to-interrogatories.pdf I hope it was ok to tag Calawyer and Sandica in hopes you may have some advices or suggestions for me and if there are links to any other forums on how to answer a generic response to the Request for Admissions, Special Interrogatories, and Request For Production Of Documents. Also, I am not sure if the Request for Admissions, Special Interrogatories, and Request For Production Of Documents have to answer on separate letters or template, or can they all be answered in one letter or template?   10. Thanks Clydesmom. I am going to definitely file BK, however I am waiting to receive a little income tax refund so that I have enough money to file for BK. I hear that once a person files for BK it stops all suit. So if I don't respond and the Plaintiff files a motion with the court, and or deemed admitted, how long before they can actually garnish my paycheck? Just curious but what will the plaintiff (Attorney) do with the RFA, SI, and RFPOD, investigate? Will these documents be presented to the court or judge too? I'll post up the questions later today when I get home. Thanks for the help.

After sending out an Answer on 12/23/15, I just received from the Plaintiff the Request for Admissions, Special Interrogatories, and Request For Production Of Documents from Mandarich Law Group for CACH, LLC today. I just need to buy some time until I can file BK Chapter 7 in April or May. Do I really need to respond to the RFA, SI, and RFPOD, and what would happen if I don't respond? I'm located in Sacramento, CA. Please share your thoughts, experience, and advices. I would really appreciate it. Thank you.

  13. Thanks for the response sadinca. When you received the discovery request, how much time do you have to respond to them and what happens after you respond to the discovery request? I just filed my Answer on 12/23/15. Should I wait to receive the discovery request or should I send the BOP now? Hopefully there's no more fees to answer the discovery and or send a BOP?
  14. Unfortunately, this is not the only credit card debt I have and plan on filing BK. However, I need time to come up with some money to hire an attorney. I am curious to know how long after I file an Answer before they get back to me. I think the last payment made on the card was in March of 2014.
