  2. @Bulldoger sorry , i am new here and made to post because i was not getting much response as to what to do or any suggestions. I can delete the other post or this one if you would like? @BulldogerI have until the 30th to file my response. I got served May 30th at 10:30am. But i want to file my response by Monday. What would by defense be? I haven’t file an answer because i dont know what to put or how to reply.

  4. @nobk4me where can I find out if my capital one contract states it is 3 years? I have until Monday to decide if I should submit my response or settle for payments and don;t know what i should do. I definitely don't have 2400 to give them right away.
  5. Thank you , I will go ahead and make payment plans including with court cost since if i understand correctly they are being generous with me by even allowing me a payment plan. Thank you for your help and suggestion.
  6. @BackFromTheDebt Someone mention that i can't do arbitration because Capital One took it out from their agreement. I don;t think it is fair that i have to pay them court cost when they didnt allow me enough time to respond to the intent to sue. I have asked for validation over the phone. They mailed me copies of bill statement and a bill of sale of the debt, however before sending this they had already file the law suit . This did not give me enough time to review the papers and determine if i wanted payment plans before they file in court.
  7. Hi guys, i am new in this forum and have been posting but looking for some suggestion. I am being sued by Resurgence Legal Group for a Capital One credit card that opened in 2015. The amount they want is 2000 + court fees. I tried to settle a payment plan however they also want the court fees in order to set a payment plan. I don't have this type of money and don't know what to do. I have until the 30th to file response to the law suit which i also don't know how to do. I am in California. I asked for validation of the debt over the phone to which they responded by mailing me a copy a bill statements and bill of sale of the debt . But they didn't give me a chance to respond to it as before they sent me the validation they went ahead and file the lawsuit . So I got the validation in the mail on May 25 but they file the law suit on the 18th. This didn't not give me enough time to respond or even look at the papers and determine to make payment plans. I don;t think it is fair that i have to pay their court fees when they didn't allow me sufficient time to get to an agreement with them as i stated they file the law suit before sending me the validation documents. Please if there is anyone that can suggest what to do? Should i just make payment plans on the debt plus court fees?
  8. @BackFromTheDebt The debt is mine and I tried to make a settlement with with but they also want to include the court cost which i cant afford. I don't know what to do but based on what everyone is telling me I guess I have to find a way to pay them back including the court cost.Thank you.
  9. Hi everyone, I am hoping someone can help me please as I am desperate. On May 11, 2021 I received a letter from resurgence legal group stating that they intend to sue. I contacted them and ask why they wanted to sue . They stated it is for a Credit Card that I opened in 2015. I honestly have no recollection of the card and checked all three of my credit reports and its not there . When I contacted them I ask for validity of the debt , On May 25 they sent me a packet with some credit card statements for court and a sort of contract that stated they bought the debt and now it is own my unifund. However, they didn't give me much time to reply to this because they file the law suit on May 18th . I don't even remember when i got serve because the person that serve me just handed me an envelope without saying anything. I called resurgence to ask when i got serve and they state that they don't know . I ask if i can get a settlement or payment plan. The lady on the phone was super rude and said that i also had to pay extra $300 for court cost. The balance is $2,057 plus $300 in court cost. I obviously can't afford this and dont know what to do. I am a single mom, and lost my brother to a stroke a week ago, I am still grieving and now need to deal with this . Someone please help. The papers they sent it states that my last payment on the credit card was May 22, 2017 , so i think they file the law suit a few days before the statue of limitations. Please please help me. Any lawyer here that can help me please

  11. @nobk4me @BackFromTheDebt The original creditor is Capital One Platinum Master Card ( At least that is what it says on the credit card statements they sent me). What is arbitration and how do i know if this is an option for me? and yes they did sent me Validation on May 25 but file the law suit on May 18th. I requested validation over the phone though and don't know if that makes a difference. I think the debt is mine but i am confuse because when i log into capital one and going back on my emails I use to have a capital one account but it says quick silver not platinum mastercard. But being that they sent me copies of the statements with my name I am assuming it is my debt. This debt according to them was open on Nov 30 2015 and last payment made on account was May 22, 2017 which i did check and looked at my bank statements and i am showing I made a payment on May 23, 2017. Should I file a response in court? and if i do, what do I put? Please help .
