  1. hi, Lekia! I don't think I got the card. I haven't heard anything. That has to be bad news. Well, when I applied online they denied me right away. But I BK on them, so that may have had a hand in it.

  4. I filed my own no-asset Chapter 7 in December. It was a joint filing (me and hubby) and we rec'd our discharged in March. Trustee for case at 341 meeting, said I'd prepared my forms better than most of the lawyers!! If you do decide to file yourself, get Nolo's Chapter 7 book. It was VERY resourceful and tells you what to do on each form.
  5. I recently filed, and was discharged, Chapter 7. After getting my credit reports I noticed that some accounts have a current status of: Included in Bankruptcy/120 past due Included in Bankruptcy/150 past due Included in Bankruptcy/Chargeoff Is this accurate or are they only supposed to show: Included in Bankruptcy as the current status? All and any advice welcomed and appreciated. LSH
  6. I filed Chapter 7 BK in 12/2004. I found out in January of this year that a creditor (who've I've listed) sued me in 10/2004 and won an affadavit judgment (was never served). I filed a motion to vacate and this was granted about two weeks ago. I subscribe to EQ's Credit Watch service and found out that they reported this judgment to EQ. This judgment did not show up on my report until a few days ago, however it lists the reporting date as 1/2005. Is it a violation of the stay for them to report this judgment? How can I get this removed? Should I just send the motion vacating this judgment to EQ and be done with it or has the creditor violated the law? All advice welcome.

  8. I have a 1995 Honda Accord that I plan to reaffirm (for personal reasons). The value of the car is approx $4650; I owe $4870. I have a second nonpossessory, nonpurchase-money security interest lien on the car for $1613. While I was originally optimistic about getting this second lien avoided, I don't know if it's possible. From everything I've read the bottom line has been that nonpossessory, nonpurchase-money security interest liens can only be avoided if the collaterel is household goods or tools of the trade; it gives no info regarding automobiles and one website said that automobile with this sort of lien is not eligible. Can anyone clarify this for me (or point me to a site that will clearly explain whether or not the lien is avoidable). I have the Nolo book and I'm still unclear. Also, if the lien ISN"T avoidable, BUT I get the personal liability knocked out in my Chapter 7 filing, the second lienholder can't repossess my car, right? Is it true that they're only able to collect if I ever choose to sell the car ( I don't plan to ever sell it). If this is so, then I won't even bother with the whole lien avoidance issue.
  9. Thanks for the advice. I've been going crazy trying to figure this out. On the schedules when it asks for the totals should I omit this amount and put an asterisk saying that the amount is dependent on the pension/401K info?
  10. Any advice is appreciated. I filed Chapter 7 on 12/15 and must turn all of my schedules in by 12/27/04. The problem: I'm unable to get the 401K, pension and life insurance values of my husband's policy. The company is giving me the run around, claiming that a Pin# is needed. We never rec'd one and getting a new one takes 5 business days. Is there anything I can put on the forms if I can't get this info by Monday?
  11. Thanks for the clarification, LadynRed. That's what was confusing me...if I'm upside down on the vehicle, and don't have any equity, does the exemption rules apply? Thanks for answering that question for me! So, just to be clear, on Schedule C, I put: Descrip of Property Special Law... Value of Exemption... Current Market.. 1995 Honda Accord...??...................$0............................$4650 I'm in Maryland; since I'm not claiming an exemption $$$ do I need to reference a law?
  12. If the one car I own has value of $4650.00 and I owe $4807.00, do I need to list it on Schedule C? There's no equity to claim as exempt, so do I just list this debt on Schedules B & D? Also, this same car has a second lien with a finance company. I plan to list this finance company on Schedule D, but I'm wondering, how does the lien get stripped? Is it done by my simply filing the Schedules and then filing a Motion to avoid the lien? Based on the info above, does a $1613 debt with this finance company impair the value of my exemption? Thanks in advance. I'm too broke to get an attorney and the creditors and breathing down my neck.

  14. Hey guys, I’ve decided to tackle this BK thing and am starting to complete my forms. I have a few questions regarding Schedule B. Any help is very appreciated. Household goods and furnishings, including audio, video and computer equipment: I have a used Gateway computer; sofa, coffee table, end tables, bookcase, Computer stand, Kitchen furniture, bed, Children’s bedroom furniture, a TV (not sure on inches; may be 27” or 32”), a 19” TV, a VCR/DVD player, a VCR. Do I list all this stuff and if so, what value do I put on this? Nothing was bought within the last year. Books; pictures; art objects….,compact disc, etc.: I only own used books, but I have many of these (hundreds). None are collectibles. I have CD’s (Approx 100), but again none are collectibles and all don’t even have cover/jacket, etc. What value do I assess? Wearing Apparel: I have no idea what to list as my value. Clothes would include mine, hubby’s, and three children. Furs and jewelry: The only jewelry we own is our wedding bands. No furs (I wish). Do I put NONE or do I list the value of our wedding bands? Interests in insurance policies: Do I list the life insurance that we pay through our jobs or is this just for an policies that we pay for on our own? Also, if I have a Gerber life insurance policy for the kids, do I need to list that? I’m sure there’s not a refund value. Accounts Receivable: The only thing I have coming is a student loan rebate in mid-Feb. I won’t know the amount that will be refunded until I register for my Spring classes. Do I need to include this info or just put NONE? Other liquidated assets…tax refunds: We owe federal, so I’m not anticipating a refund. State is a possibility, but I have no idea what the amount would be; do I guess or say NONE? Automobiles, trucks, etc: I have 2 cars; 1 leased (being returned); 1 financed (that I will reaffirm) I have no equity in the car; do I list the value of the car or put NONE?
  15. Is it feasible that they would do this? I owe my credit union what the car is worth, so the second lienholder would get nothing for their efforts. Is this something I should worry about? If so, is it best to go ahead and file BK now and if a problem crops up, I just amend later? (NO $$$ available for lawyer).
