  1. Please help me, I'm about to go on a rampage!! Long story short, Sears sold my charged-off account to, uh, let's call them 'Herman A%&wipes'. They turned it over to a collection agency, and after some violations, we settled to matter out of court. And I did sign a release. Two of the things were forgiveness of the debt and deletion from bureaus. This was over 2 months ago. Since then, they have put it on 2 bureaus. But here's the kicker, 'Herman' sent the account to another collection agency and they have called me everyday since Friday wanting me to pay this. I have repeatedly told them it was settled, call them and STOP calling me, but they won't. Last message on my machine was I had to call them by 9 pm tonight and give them my lawyer's name and number. There has to be some way out of this harrassment. Any suggestions? Thanks
  2. I tried to get TU to change my last name and they refused to do it. They sent me a letter that said: Re: Name Change Creditors add your name into their records exactly as you have provided it to them. They then report your name to TransUnion as it appears in their record. If you would like your name to appear differently on your credit report, contact your creditors directly. anybody know how to make them change it without going directly to creditors?
  3. My husband and his ex-wife filed Chapter 13 almost five years ago. They split up, we got together and we got stuck with every single payment. Every single payment, and we were never able to get her to help, even though her name was on it too. It got so bad at times I had to let my bills go at times so we wouldn't be late on the the payments to the trustee. And this wasn't even my bankruptcy!! (The things we do for love!) We are now awaiting the final discharge from the trustee and let me tell you it feels so good to be out from under all that crap! I see alot of people asking would you do it again...He says H*ll no, I say H#ll yeah. By no means is it easy, we ate alot of sandwiches for a while, but now we are out from under it and he has no bills except the house payment and household expenses, and we're FREE AT LAST! FREE AT LAST! It's hard, but it can be done. HA! WE DON'T NEED NO STINKIN CREDIT!
  4. when suing a ca, is it better to file small claims court or in civil court? In regards to small claims, do you have to file in venue the defendant(CA) lives? If it's civil you have to file in, does anybody know which forms to use (for fdcpa violations)? Thanks.
