  2. Thanks for the info. In the demand for payment letter should I give them a timeframe in to which I expect payment to be made? Something to the effect of you have 30 days from the receipt of this letter to make restitition or ....... and then inform them of what other steps can be taken if restitution is not made by then. Do we have a form letter for this that I can edit? Thankgs again...
  3. This was in regards to Experian not providing a proper procedural. The representative showed the judge some documents that had the info that I was requesting that they just did not provide to me. I had been receiving the usual previously investigated and their disclaimer on we verify either electronicaly or blah blah blah. Once the judge saw the info that I was requesting he simply asked them did you provide the plaintiff with this information since you have it accessible. their answer was no and then the judge awarded me with a judgement against Experian. This was in small claims court in Texas. Does anyone know how much time they have to appeal the decision?

  7. Can anyone please provide me with a link that may have some FTC opinion letters in regards to procedural requests?
  8. I am going to finally file against Experian in small claims court. I currently have them on 5 violations of FCRA 611 (6)( (iii) which is the procedural request. "a notice that, if requested by the consumer, a description of the procedure used to determine the accuracy and completeness of the information shall be provided to the consumer by the agency, including the business name and address of any furnisher of information contacted in connection with such information and the telephone number of such furnisher, if reasonably available" Now the question that I have is after reading through the FCRA civil liability it reads " any actual damages sustained by the consumer as a result of the failure or damages of not less than $100 and not more than $1,000; or (2) such amount of punitive damages as the court may allow; and (3) in the case of any successful action to enforce any liability under this section, the costs of the action together with reasonable attorney's fees as determined by the court." Since it's the same violation even though it's been 5 times I can only sue them for $1000.00? The reason I ask is that I do not see anything that describes the $1000.00 per violation. Any help would be great.

  10. I would also be interested. I know that Sherman Aqusition isnt bonded in TX. So does that mean that they legally cant collect on this debt in TX?
  11. So does this mean that if you live in TX and Sherman is trying to collect on a debt ---- they have no legal right to collect on this debt? If so do you suggest attaining "a certificate of no record" and forwarding a copy of this to them and informing them to stop their collection activities along with removing their entry from a credit report?

  14. Thats funny because it's a K Jewelers account I was posting this about. I dont want to charge it up and pay it off only to have the high balance count as my credit limit. I dont need or want $7000 worth of jewlery. I wonder if I charged one item during they reporting period and returned it during the return period. Do you think this would possibly show on my report? Has anyone tried this yet for a similar situation??
