O.k....so if validation needs to come from the OC via the CA, and they either did not, or were not able to do this, it sounds to me like my next step is method of verification, follow up letter to CA demanding further validation, wait, then use MOV to have CRA remove and ITS (if necessary) to get the CA to stop reporting. does this sound right? Also...I posted this question in a different post but didn't get an answer. Do you know if MOV has to be done CMRRR or can I do it via phone? and... Is there an MOV letter on this site? I couldn't find one. Thanks

  3. Hi everyone: I've been battling A$$et Acceptnce for awhile now. Have these 2 paid collections on my report. Tried disupting as "to be deleted upon payment per agreement" but that didn't work. Account #1 had always been negatively reported. Account #2 used to read PAID, but they recently changed it to PAID COLLECTION...this happened as soon as I disputed another account with them. I paid the 2 accounts in September of 03. Here are how both accounts are reporting... Does anyone see anything that is of good use here?   4. O.k...so I'm in the middle of the 1-2 punch with Asset Acceptance. About a week after the 2nd CMRRR validate letter went out I get their "supposed" validation documenents back from them. Basically it is a note on their letterhead that says "Based on information provided to us by the original creditor" And then it lists the account number, principal, interest and total due. These are for 2 utility accounts. They provide no original documents, nothing that shows the supposed dates from the old account etc. etc. etc. the only thing it shows is the original account number. I'm assuming that they have not fulfilled their obligation to validate since iit would appear that they have no original documentation. They have verified the accounts with the CRA's So....what is the next step. Is there a follow up letter I need to send to Asset stating that they still need to produce some more info? Thanks in advance for your answers.

  7. Hi all and thanks in advance for your answers. Question 1. I'm in the process of the 1-2 punch with Asset Acceptance. I sent them a validation letter with a limited cease and desist clause stating that they could only contact me in writing. The calls stopped for a little bit, but now I'm getting these recorded messages left at home..."this is not a solicitation...this call is for MYNAME...please call 1-800-123-4567." So...is this continued collection activity? I've got one green card so far from early June, other one went out just recently.. I've been saving the messages on my answering machine and have a tape recorder ready. Question 2. I was getting ready to do the 1-2 punch with RMA when I read a little here about just sending them a letter telling them that the debt was time barred and beyond SOL etc. DOLA is 10/97, they've changed to 10/98. Either way, it's past the 6 year SOL in michigan even with their re-aging. So...do I DV them or send them the "time-barred" letter? I faxed them a DV cease and desist a couple days ago, and all that got me was a hard pull the next day. Suggestions?

    Here's another question I have. I recently disputed with the CRA's for Risk Management Alternatives. This was for an old Sears debt that they have reaged. Reason for dispute was that the DOLA had been changed. Balance showing was for an old Sears account, ..1,000 bucks. The account came back verified, but is now showing as a PAID COLLECTION????? They've never received one cent from me. Should I just go ahead and DV them? I've never had an account switch to PAID from a balance before so it's got me wondering.
  9. Hi everyone. I am dealing with a CA over several small accounts. They have never sent me any collection letters so I'm thinking they have an incorrect address. On 6/1, I was contacted at work by the CA. I told them never to contact me at work again. On 6/9, she called work again. On 6/10 I sent out a Validation letter with a C&D paragraph in it. I also told them that I have never received any correspondence regarding these debts. 6/13 Another phone call to work. Woman threated to turn me over to legal. 6/14 my letter was rec'd, signed for, got the green card etc. 7/13 Yesterday...got phone call from different woman at home. 2 of the 3 accounts are gone from my CR now. One of the accounts remains. It has NOT been listed as disputed. Am I starting to get any violations going here? How long after my letter is delivered does the C&D go into effect (although it seems the first time I told them never to call at work should have sufficed.) I am in the process of disputing the accounts with the CRAs right now. I'm just wondering when I've got some valid violations.
  10. Sorry to be so thickheaded about this but I want to be sure I'm understanding this correctly...All 3 of my AMEX accounts have a DOLA of 9/98. That would set the SOL to 9/04 in my state, which means that if they were to sue, I would have an absolute defense right now. The seven years + 180 for how long this can be reported would be 3/06. AMEX can report this account as a Charge OFF (not a chargeoff/sold to another lender) and also show a balance. So right now, if they sue, I've got a defense. If they don't, hip hip hooray and I wait until 3/06 to demand that the items be removed because the 7+180 is up. IF they remove it, there is a very very good chance that at that time I will receive a 1099 on the amounts owed. Do I have this correct or am I as dumb as I feel right now?
  11. check out the "read before posting" announcement. It's got a sticky that is a glossary of all this stuff. CA, OC, CRA, CMRRR etc.etc.etc....It'll be worth your while. It stands for Certified Mail Return Receipt Requested and basically it means you have proof that your letter was deliviered.
  12. another thing you can try, if the accounts remained with the credit card companies and not a collection agency, is a goodwill letter to one of the higher ups. I got Discover to remove 2 accounts from all 3 bureaus simply by emailing the higher ups. No guarantee, but sometimes a nice "I've paid, I've learned my lesson, please let me get on with my life" letter to the right person gets it accomplished. There is a sticky in the collections forum called "Ways to remove paid collections". You should read that too.
  13. Again, I'm no expert, but I think there's a couple things that coulda happened. First...did you enter into a monthly payment agreement when you paid those accounts? That can reset the date sometimes I have a couple of paid collections on my report (I paid them botth as lump sums, not monthly) , and they show as date opened of 2003, but they are reporting a date of last activity of 10/99. I I've had luck on the phone asking the CRAs what they are showing as the DOLA for particular tradelines. If you've saved old reports you can cross check and find the ones that have changed.
  14. I'm not an expert, but I'm pretty sure that the different CRA's don't really care about what others are reporting. Telling them that a TL is not on another report won't matter to them. It could just be that the creditor only reports to one bureau. You can always dispute a Paid Collection as "To be deleted upon payment per agreement", even if you don't have a letter. If it's old enough, maybe the creditor doesn't have records of it any more. and won't be able to verify otherwise.... Also, check the dates of the tradeline, make sure things haven't been changed to stay on your report longer I don't know anything about midland or portfolio, but if you use the search feature for this forum I guarantee that you'll get some info on them
  15. so.... I understand that AMEX will just hang onto the debt, and that it will be there forever. They do have to stop reporting it eventually So, I guess I dispute some of the other erroneous info. with the CRA Can I DV AMEX though so I can see what the true dates are?
