  2. This case is in the Circuit Court of Madison County. I am confused, though. What does "Order on Pre-Trial Discovery" mean? Is it different according to the court.
  3. Thanks, I read the area dealing with "discovery," but I still don't get it. I am going down to the clerk's office tomorrow and try to find out more information, particularly since I was never asked to answer this complaint. Apparently, there is something that is a part of the docket notice and I am able to obtain at the courthouse.
  4. Could someone please interpret this for me, please? It is on a notice I received with my court date: CIVIL NON-JURY TRIAL DOCKET: DISCOVERY WILL BE GOVERNED BY COURT'S "ORDER ON PRE-TRIAL DISCOVERY" (NON-JURY) -- WHICH IS MADE A PART OF THIS DOCKET NOTICE AND WHICH MAY BE OBTAINED IN JUDGE SMITH'S OFFICE. A NON JURY TRIAL HAS BEEN SET IN THE ABOVE STYLE CASE ON THE DATE AND TIME INDICATED. FAILURE TO APPEAR MAY RESULY IN A DISMISSAL OF THE CASE OR AN ENTRY OF DEFAULT. I pretty much understand the second paragraph, but what does the first paragraph mean? Thanks.
  5. Oh, I am definitely going to show up for my court date. The last time I was served, I received the Statement of Claim and then the court date in the mail about three months later (after I answered the claim--which I had 14 days to do). I think this case was filed in August or September. Am I still allowed to go down and answer the claim although 14 days have passed? The ppostcard has the case, judge, date and place.   6. Last week, I received a notice from the county courthouse that I am being sued by First American Investment Co LLC. I never received anything prior to this from the courts. I live in Alabama. The last time I was sued (by a creditor--which I won, BTW), a sheriff came to my door with a Statement of Claim from the court which I had to respond to in 14 days. This time, I only got this notification of "trial--bench" and the date. It also says that this is "civil non-jury trial docket." I don't even know the amount for which I am being sued.   7. I just want to know--what are my options for answering a claim? I was told that I need to come to the Courthouse to do this for a charge in small claims court and one for the circuit court. I don't want to go in there totally ignorant. What are the options for answering? Thank you.
  8. I know they can only take a small percentage of my assets if I did have a job. I have had a very difficult time finding and keeping a job in the state of Alabama (which is the reason I have so many credit problems now). I incurred these debts in Georgia, and we now live in Alabama. If I was in GA, the statute of limitations would be up by now--they are a year longer here in Alabama. Is it a good idea to respond to these allegations (I plan to deny), and then, when they next respond, file a counterclaim?   9. I don't have a judgement yet. What is an "answer form"? Is this something I file after the judgment? Or must I send that with my response to the complaint? I don't think the sol has run out. The account was closed 9/2003. The last time I paid on it was probably 4 or 5/2003. Thank you all for your advice! This is really stressing me out.

On January 30 of this year, I received a letter from the Law Offices of Holloway & Moxley stating that their client (a collection agency) referred a past due account to their office for collection. They said I had 30 days to respond/dispute validity. I responded on February 7 with a letter sent "pursuant to the Fair Debt Collection Practices Act, etc..." saying that the claim was disputed and I requested validation.   11. I just got a letter from them on Monday attempting to collect on the same account that Cambece (for Arrow and CACV) are currently trying to collect on. I have seem info on these others but not Astra. Does anyone have any experiences with them? Thanks.
  12. I went home and looked at all my letters, and I wanted to clarify something I made a mistake on. I have two letters from Cambece. One of my letters from Cambece says they are attempting to collect a debt for Arrow. The second says they are trying to collect for CACV. I have another letter from Astra Business Services who is trying to collect the same debt for CACV. All for Maryland National Bank and same account number. I also have an "unrelated" letter from Arrow saying they are collecting on a different account for Citibank. Okay, I think I have it all straight now!
  13. Thank you so much for the link! I was surprised to see Scott Lowery's name on that list! This is the previous "attorney" that had been trying to contact me (maybe a year ago). I haven't been answering the phone and talking to these people, and now I have asked that they quite contacting me over the phone. One of these collection agencies, I don't know which name they were using, actually told my dad I was being sued. Hopefully, I will be able to get rid of them soon!
