  2. I was just served paper tonight. I live in Texas! 1. Who is suing you? LVNV 2. For how much? $20,042.68 3. Who is the original creditor? Sears 4. How do you know you are being sued? SERVED WITH PAPERS 5. How were you served? Were you served? IN PERSON, AT HOME 6. What was your correspondence (if any) with the people suing you before you think you were being sued? LETTERS from LVNV, Ignored 7. Where do you live? TEXAS 8. When is the last time you paid on this account? From lawsuit it says 3/28/03 9. What is the status of your case (if anything has been opened)? You can find this by a) calling the court or looking it up online (many states have this information posted daily). I need to file a written answer with the clerk by 10am on the Monday next following the expiration of 20days after served. 10. Have you disputed the debt with the credit bureaus (both the original creditor and the collection agency?) NO, just ignored everything. 11. Did you request debt validation before the suit was filed? If not, don't bother doing this now. NO 12. Does your summons require a response? (Look hard!) If you don't get a questionnaire with your summons, you are still probably required to answer it in writing. If you don't respond to the lawsuit notice you will lose automatically. In 99% of the cases, they will require you to answer the summons, and each point they are claiming. We need to know what the "charges" are. Please post what they are claiming. Did you receive an interrogatory (questionnaire) regarding the lawsuit? Would this be the Plaintiff's Request for Admissions? Plantiffs Request for Disclosure? It says for this, Pursuant to Rule 194, you are requested to disclose, within 50days of service of this request, the infomation or material described in Rule 194.2. I am confused since it says on the first page that I have 20 days and I have to appear in Court by filing a written answer to both. I am really confused. Sorry. There are 21 reason's I should pay or dispute. They say that the Affidavit attached to the Plaintiff's original petition and any amendments has necessary elements to prove up to the existence of the account made the basis of the lawsuit, principal amount due, prejudgement interest and/or that Plaintiff is the assignee of the original credito or its assignee. 13. What evidence did they send with the summons? An affadavit? A statement from the OC? Anything else they attached as exhibits? Affidavit of Account from LVNV funding, LLC from a authorized rep from south Carolina. 14. What is the SOL on the debt? To find out: 4 YEARS Any help would be very appreciated. Reply With Quote
