  1. In regards to receiving a letter after a rude phone call (it was sent 6 days after the call but I am not going to get that picky) however, it gave me only 10 days to respond, not 30. Is there a quote from the law books (Fair Debt Collection, etc...) I can send with my letter to them? THey mentioned the OC and the amount owed pluse more $$$ for this and that. DO I still send a DV or ???? Thanks Tracy in Texas

  3. I looked at the BIG 3 CRs of mine and found the following... 1. I have closed credit card accounts from 1999. Can I ask the CRs to remove them? 2. I have old school loans that are paid off and past 7 years. Can I ask for these to be removed? 3. I have one big loan from Sallie Mae but it is reported 10 different times with only one showing a blance and the others showing 0. Can I ask them to remove the duplicates? 4. Is it true that inquiries from companys only stay on your report for 2 years? I received this email newsletter that stated... (Credit inquiries (requests by companies for a copy of your report) can stay on your credit report for only two years. eCredit Update <TripleCrown.noreply@us.emaildirect.com) Finally, do I go through the online dispute process to ask for removal, or by some other means? ie, Letter.   4. I sent out a DV letter on a debt bought by a CA becasue they sent me a letter in January. They sent a letter back with quotes from Section 809 blah blah blah. I am ok with that. I understand and agree that they do not have to give me a whole history of the debt. Here is the OC and account number and amount. Cool. FIne. Whatever! Enclosed with the letter was an Affidavit of Account where the Preseident of this company signed this ..." sound mind and capable of making this affidavit... you owe this much, pluse this much interest...blah blah blah" and had it notarized. THis company is located in Utah. Ok...point is, this debt, which is in the hands of it's 4th CA is past SOL and will "fall off" my CR in 2008. Should I do anything now? In Texas

  6. In a nutshell....January 25 at 8:30PM I receive a phone call from a CA. They are RUDE, threatening to sue, try to get me to verify SS#, blah blah. I verify nothing, stay calm on the phone and ask for a DV letter. They say they don't have to, more rudeness, I get fed up and hang up. They call back immdeiately. Yes, I answer. More rudeness, I tolerate about 30 seconds and say "I have no idea who you are or what you are talking about. Send me this in writing. " I hang up. (This is actually VERY true...I have never heard of these people) February 12 I receive a letter dated February 6 from this company. It reads (EXACTLY)..... My name and address Account Number Creditor File Number Present Balance: $5874.68 Monthly Payment Amount: $5802.20 Total Amount Behind: $5802.20 Dear "me" The aforementioned debt has been sold by FLEET/BANK OF AMERICA the rights to this debt have been placed with our office. With respect to your monthly or periodic payment arrangements which were negotiated in this case, you are in default. Before proceeding wiht appropriate legal action against you, this letter is a notice of that default and serves as demand for payment sufficient to bring your account current within ten (10) business days from the date of this letter, If that payment is not receivved, you will receive no further notice before further legal action is taken against you. Your current arrangement is noted above. Payments should be mailed to our office in Rochester and made payable to Genesee Valley Associates, Inc. Please include the file number also referenced above on all payments and/or correspondences. If you have any questions blah blah blah with phone numbers and business hours. It is signed by the RUDE woman who made the phone call to me...It seems she is also the Account Manager. Information and Questions: The SOL on this original debt is WAY past due. The OC is due to come off my CR in 2008 This CA has not reported to my Credit Reports I never agreed to any "arrangement." My next step? tracemb14 in Texas
  7. I just received confirmation from the Northland Group, INC in Edina, MN who had a PO Box address and it was signed for. Weird but I got what I needed for documentation. 8-)
  8. So the rude phone call I received last night from a company I have NEVER heard (not on my CR either) has 5 days to write me (I requested this 4 times while on the phone) and then I have 30 days to duspute? Do I address their rude behavior? In Texas
  9. I received a phone call from someone named Pam from Genesis....that is all she would say. Her tone started out rude and only got worse. She claimed to have a debt of mine from MBNA. She asked me to verify the last four digits of my SS#. I did not. I was caught off guard by her tone so I was not as forceful with my responses as I had hoped to be. I told them I was recording (unfortunately I wasn't) I TRULY am not aware of this company as they do not show up on my CR's...although she claims they do. Anyway...in short, she said things like, "If you could read your report..." "Like you could quote a law to me..." (when I attempted to speak of the Credit Reporting Act). "Why can't you just own up to this debt. You know it is yours." "I do not have to validate anything to you." You stole $6000 and don't want to pay it back, right lady?" I asked 4 times for them to send me this in writing and they said "No, let's settle this on the phone." Finally I said "This conversation is over, goodbye." And I hung up. They IMMEDIATELY called back. I answered and Pam said, "We are suing you." I said, "Do what you have to do." She attempted again to get to me admit things, settle on the phone, etc. I stayed persistant with "Send this to me in writing." This time she said, "There isn't enough time." I repeated, "Do what you need to do." She handed the phone over to her ""Credit Supervisor" who asked, "What is the problem?" I said, "First, Pam was rude and threatening. Please send this information to me in writing." This waoman answered with "We don't have to." And I replied, "Yes, you do." Then she said "why are you being so irresponsible. Just pay your debt lady." I got really tired of the LADY thing and said, "Do not call my home again. I do not own this debt and will not be treated this way. You are in violation of the FDCPA and I have documented this coversation." Goodbye. Holy cow....this left me stressed the rest of the night...although I didn't lose sleep over it. Suggestions as to what to do now? What I have written is really all I know about this "Genesis" company. Thanks ya'll In Texas

" WHat does this mean exactly? MONROE AND MAIN Address: 1112 7TH AVE MONROE, WI 53566 No phone number available Account Number: xxxxxxxxxx Status: Account charged off. $201 written off. $100 past due as of Jan 2007 Status Details: This account is scheduled to continue on record until Sep 2009. This item was verified and updated on Jan 2007. Date Opened: 11/2002 Type: Revolving Reported Since: 06/2003 Terms: NA Date of Status: 06/2003 Monthly Payment: $0 Last Reported: 01/2007 Responsibility: Individual Credit Limit/Original Amount: $201 High Balance: $201 Recent Balance: $201 as of 01/2007 Recent Payment: $0 Account History: Charge Off as of Feb 2006 to Jan 2007, May 2004 to Dec 2005, Mar 2004, Jan 2004, Jun 2003 to Dec 2003 And what is this date range all about?   13. Thank you so much for the explanation...it was very clear. I have one last question for right now as I continue to inform myself about all of this. This is from my/your last post to me.... Federal Pacific who bought Discover has an Account History notation of May 2006? Answer: May 2006 must be the date when Federal Pacific purchased or reported to the CRAs. Discover still should fall off in 2009, according to your info. I understand the 7 year reporting on my CRA and understand Discover should fall off in 2009...but what about Federal Pacific? Does each time a JDB buys my debt they get to start with 7 years? If so, this could go on and on forever???? My originals will fall off but each new JDB will just come in and replace it?????

I am well aware of my rights under the Fair Debt Collection Practices Act (FDCPA) and my state laws so I hope to save both of us a great deal of time by letting you know that not only do I dispute the validity of this debt, I have also checked with my State Attorney General and verified that the Statute of Limitations for enforcing this type of debt through the courts in (insert your state or the state in which the contract was signed) has expired.   15. My debts are all past the SOL for Texas yet I have received 2 letters (for 2 different debts) this January (2007). Of course this is due in part to the fact my debts have been sold AGAIN. So, do I send a SOL letter to this new CA or will that restart my SOL? These debts will be "off record" in 2008 but I hate receiving letters from creditors and all the threats they make. I read through several pages in this forum but didn't see a specific answer to this. Thanksxdancex
