  1. Came back from my long awaited forced mediation battle with Bluestone investments , (check out my other posts)a low life CA in Pennsylvania on August 12, 2008. Went to court that morning, the low life CA lawyer , I understood he was one of the top 3 partners in the lawfirm, showed up with the secretary that handles their paperwork as a witness (ha..ha.ha how pathetic) He claims that she had knowledge of ..get this..the original debt..she claim my debt was valid because she had received the paperwork from the original creditor..(which was a lie because the debt was never sold to them directly).

  3. Hey ..check out my post..I've been fighting bluestone investments for a debt of $ 10,000 and it's about to come to an end..with victory to me.and i've been representing myself pro se.call up the court house and tell them that you will show up..is it magistrate or civil? I can help you..

  5. I have been in a battle with a CA (Bluestone Investments)for almost a year now. They say I owe them $10,000 Because the CA purchased my account from Metris Bank the original creditor (which is HSBC) and that they are the assignee.To make a long story short they lost on the lower court and then appealed and the case was sent straight to Arbitration..In PA the courts can do that.They subpoena HSBC for statements .They were sent 6 copies of statements, no contract.no payment history..so since 10/07/03 no payment was made..a year before they sold it.and last purchase I made was 3/18/2004..Also ..
  6. this been going on a year . went to district court where the judge dismissed the case without prejudice even though the CA had nothing. no contracts no paperwork. the CA appealled to civil court. the civil judge automatically sent this case to arbitration it's his discretion to aleviate the backlog of cases, no one has to be asked, which in PA they can do without hearing any arguments. now it's civil court i've answered the CA discovery ,production of documents, I'm still waiting for them to answer mine. according to PA civil rules they have 30 days ,they still have 4 more days. the case has
  7. I am in a battle with a CA. The court sent it to arbitration, I want a jury trial.how do I word my pleading for a jury trial?. I am countersuing the CA and i'm afraid if it goes to arbitration they might try to pull a fast one on me.. can i say "in pursuant of civiil rule 1007.1 the defendant appearing pro se demands a trial by jury " and should i envoke the The Sixth Amendment which guarantees the right to "a speedy and public trial, by an impartial jury ....found the PA rule that refers to this RULE 1007.1. I countersued based on the Fair Debt Collection Practices Act under 15 USC 1692e(2) and (10) Pennsylvania Credit extension Uniformity Act 73 P.S. ยง 2270, et seq and Pennsylvania Unfair Trade Practices and Consumer Protection Law. whether I get it or not is one thing >I threw it out and maybe if i could just prove one or two of those violations I can make them pay..Who knows stranger things have happened.
  10. but how bout my time and money spent defending this lawsuit..I did counter sue for damages..for about $80,000 in violation, suffering,embarrasement etc...etc...was that a good move?
  11. so back to my original point , in the lawsuit the CA sued on the basis that they are the owner and asignee of the debt and therefore i owe them, which they have not proved, that is why they are trying to subpoena the OC to get paperwork. I will object to a third party being subpoena and i will point out since they claim to be owner and assignee they should already possess these documents. If not then the lawsuit was filed without merit and i will demand compensation..am i on the right path?
  12. but they never purhased the debt from the OCand the OC did sell the debt. the ca purchsed it from another jbd. How can they be an asignee if they purhased it from a third party? according to law you cannot be both purhaser and assignee is that correct?
  13. What did they DV you for? documents from the OC..but i claim no knowledge since validation was not provided. They asked for production of documents and credit card statements,and copy of contract ,cancelled checks. They claimed they are are purchasers and assignee of the OC, which they cannot be both, plus they never purchased it from the OCif a couple of JBD bought it first. Who gave them only 30 days?
