  7. Yay! Good work Amerikaner83! I like the way you paid attention to the benifits, annual fee, and having to charge $30,000.00 a year to get a decent amount of bonus points too! PS. What did you mean by a legit AMEX?
  8. "6.If they haven't sent you satisfactory proof, and are still reporting this on your report, send a copy of your receipt for your registered mail, a copy of the first letter you sent and a statement that they have not complied with the FDCPA and are now in violation of the Act. Tell them they need to immediately remove the collection listing from your credit report or you are going to file a lawsuit because they are in violation of the FDCPA, section 809 (." http://www.creditinfocenter.com/rebuild/debt_validation.shtml If they still don't remove it file a complaint with the BBB, FTC and the AG. If it is still not removed file suit. *Usually just a follow up letter stating their violation(s) is enough.

  11. 1) should i initiate contact with zwicker and offer a settlement to clear my credit or am i better off waiting for zwicker to initiate action? Send a DVL if it is still on your credit report. Did they send anything in the mail when you sent the DVL besides calling you? http://www.creditinfocenter.com/rebuild/debt_validation.shtml Did your DVL include that no telephone contact be made by your offices to my home or to my place of employment? Catch them in violations. http://www.creditinfocenter.com/eBooks/PoorMansClassActionLawsuit.shtml 2) is it possible to offer a settlement to zwicker that includes credit reporting deletion by amex? Yes. http://www.creditinfocenter.com/debt/settle_debts.shtml 3) if that is not possible, what is the best credit reporting notation that i should ask for? i saw someone reference a thread that listed the order from best to worse (paid as agreed, settled for less, etc etc). Here is the link for negotiating your credit rating. http://www.creditinfocenter.com/debt/neg_rating_after_settle.shtml

  14. 1. Can the collection agency report this debt again on my report? even without any related address on my credit report and SSN# (as no SSN# was used when opening this account)? Yes. That is great that you sent them a DVL certified mail too. You can sue the credit bureaus if they reinsert a removed item from your credit report without notifying you in writing within 5 business days.Per the FCRA Part (A)(5)((ii) 2. What could be the reasons that this bad record have gone? I wanted to know if there are actually something preventing the collection agency from reporting this bad record. The debt is still in SOL. Maybe the CA realized they didn't send you a dunning letter first. Pulled the collection, and sent you a letter in Dec. instead. Either way keep watch of the credit reports. Or maybe the collection was on there 7 years already. If you have old reports take a look at how long the collection was on there. Or simply call the credit bureau and ask when the date was it was put on, and the exact date it was removed.
