I did try to find if this question has been asked, didnt come up with anything. anyway, portfolio sued me a couple of years ago, their lawyer didnt bother to show up for court. the judge got me on the phone with him, said he was going to get me some info and mail it to me and never did. (because i told him i didnt know what i was being sued for) a few months ago i started getting calls again, so i sent off the letter to cease and disist (green card). now they are calling again. the sol is up in feb or march of 2010 so do you think these bastards will go for it again? the last time i ignore
  2. i had a couple of things on my credit report, don't know where they came from. but i wrote the 3 reporting agencies and they investigated and deleted them off my report. then i get the dunning letter from some lawyers office/collection agency. i look at the letter and the old cra report - 1st thing i notice is the letter has the account number from one and the $ amount from the other??? anyway i send off the template to please validate (from this site) and threw in that it was deleted by the cra's i get a letter today saying i failed to tell them what/why i was disputing? attached was some
  3. ok, i have a stupid question. for this motion for a summary judgement..... the box where it says. "Defendant in this case, states:" i don't know what to write. we never went through any kind of val/int. actually never spoke or exchanged mail except for the summons and answer. can i just write in my own words? "the plaintiff failed to show up for court date" you know, if it was me who failed to show, they would have gotten a default! thats not fair.......
  4. i decided to put this on a new thread as well, nobody was reading my old one..... well i went to court, i was surprised when they called my name there was no lawyer for the plaintiff. the judge said the lawyer wanted to talk to me to see if we could come to a agreement. so a women took me out in the hall connected me to the lawyer. the lawyer asked if i would like to come to an agreement. i said, i don't know what this is about. he said something about a credit card back in 2003. i said, i don't recall. so he said, he was going to dismiss the case, have his clients get copies of the statements

  6. oh you give me hope! i go to court tomorrow morning - i didn't do anything but answer my summons - (have no clue what i'm doing) of course i get a message from the lawyer the night before to see if i want to settle...... all i can do is show up and see what happens. i pray they do the same thing with me. congrats!
  7. well my court date is next week and i havent recieved any questions from the lawyers nor did i send them any. i have a funny feeling they are expecting me NOT to show up. oh well, wish me luck! i'll let you guys know how it went. on one good note. after doing all the reading here. i sent out a few letters. the CRA's have deleted some old accounts that weren't mine and i DV'd another old bill and i just got the letter that they closed the account. once i get this court date dealt with. my credit report shouldn't have anything left on it. oh, and i also put a freeze on my credit report
  8. i sent my dv letter off on 3/3/08 and just yesterday i recieved a letter from them (CA) that they closed my account...... i hoping thats the end of it!

Thanks for all the answers. i'm not looking to become a self-made lawyer. or someone to do my work for me. or be spoon fed (as i've read on here) i just wanted to hear about other peoples experience in court when dealing with lawsuits by collection agencies. i especially like the ones where we win!

  12. sued by collection agency? can you share your experience? what were the circumstances and did you win or loose? how would you handle it differently?
  13. i recieved the summons and court date. no questions were in with the summons. should i be expecting a questionaire from the lawyer now? and should i send the lawyer request for discovery? or should i just wait and show up in court and hope the lawyer is not prepared and ask then to see the proof that this is mine? if they don't have proof on the court date, can i ask the judge to dismiss with prejudice or will the judge give the lawyer time to go get his proof? also, when i request to dismiss with prejudice, do i have to file that first or just ask while in front of the judge?
