  1. We have looked into LLC for future business protection. LLCs cost about $500 per year, so until we get closer to our goal, we will be saving our money in the CookieJar and doing more research. Thanks again for all the suggestions!
  2. I might be able to start sending them a couple hundred a month. Do you think that would cause them to back off? Will it trigger anything that might bite me? I don't have enough to even offer them 5 cents on the dollar, so probably don't have a leg to stand on in trying to get them to reduce the amount.... Dang intrest is close to $5.00 a DAY! BK is looking like less of an option due to that darned rental property.... sigh. CookieJar
  3. Have a Judgement against me that is well beyond my ability to pay, and it's adding close to $5.00 interest daily.Court ordered levy of bank account. <good luck with that, everything is hidden in our CookieJar!> Have already lost our house, living in a travel trailer on family property. Husband has full time job, I am self-employed to help out. We have multiple vehicles and trailers, nothing newer than 20 years old. Situation: Back when I had the better credit rating, I was part of the mortgage refi on a rental property that we own 50/50 with husband's family. The property has no comps

  5. Thanks for the kind words and advice. I need to get this behind me. I have been told that I will be inheriting some property and don't want to have this screw up that future. I will start another thread regarding the questions I have concerning my situation and which BK I should persue. Thanks again! CookieJar
  6. Thank you for your reply and giving me something to chew on. After searching the forums to define some of the terms you used, I don't believe that it is a debtor's exam. It was not to be turned in at the court. The original judgement was for 16k, which is now 23k with all the interest added. I think it came into effect in '13. I've used the debt calculators and there is no way I'm going to be able to pay it off... I've got to ground.... living out of the cookie jar as it were. Almost everything is now in my husband's name, God help me if he dies! I really want a clean slate so have been
  7. The levy is a money judgment that lists only a bank where there are two accounts. One is in my husband's name only, the other is a business account. None of the exceptions apply. ie no soc. sec. deposits, etc. First question: Can they attach my husband's seperate account even if he is not named in the judgement nor the levy? (Community property state) Second question: Do I need to give them my financials and list all of what I want excempted if that is not what they are trying to levy? I feel like if I do they will go fishing and come back with a "force to sale" levy. The clock is tickin
  8. I really would like some help with this. I thought I explained the situation with enough information without getting into personal detail. What information do I need to add to get a reply? Help! Thanks!

  10. Thanks Admin! That's what Hubby said too... Gonna squirrel away the shekels in our CookieJar! Also a BIG THANK YOU to Admin for this site!!! I've visited and gleaned for a few years now and REALLY appreciate the opportunity to do so. It's good to know that we are not alone in this! Thanks again! ~CookieJar
  11. Thanks for your feedback. The only assets we have are a "fleet" of old trucks... a mid '30s, a '46 (neither run) & a '47 and a "newer" 78 school bus that we will be living in on the farm. I'll take a look at IRS Form 982 and see what works best. Thanks for the tip! We are so tired of the rug getting pulled out from under us! We just want to regroup, get back to the land and breathe. ~CookieJar
  12. Additional info: I found out during my research that I am not eligible for the HARP since Freddie Mac acquired my loan (without my knowledge!) in 2010, which is after the 2009 deadline. The property taxes are due in a couple of days... Can anyone give me a likely scenario to my earlier question??? Thanks! CookieJar
  13. In the instances of the mortgage not being paid, are the property taxes being paid or not? If not, how is this affecting you?
  14. After reading tons of posts here on the Mortgage section I am pleased to know that 1) We are not alone & 2) We're not as bad off as some people. Background: Bought house late 2000 with proceeds from divorce used as down payment. Remarried in 2003 and refinanced in 2004, taking $ out to build a 24' x 36' attached covered patio/workspace addition. 2008 cut up all credit cards and stop paying those bills as I had lost my job and couldn't pay them. Current: Hubby & I want to move out of the city limits and back onto my parent's land, to be closer to them as they are declining (in their 8
