  1. I did get all my accounts settled with the terms in writing. All of my accounts were still with the OC but I dealt with attorneys or a third party collector. I have not had any problems with anyone taking more than what was agreed upon from my account or anything like that. I am well aware of the tax implications and will have to deal with it but this was the only way out for me.
  2. I am happy to report that I have settled all my outstanding debts. I had $35,102 in credit card debt that all charged off over about a year ago. I was able to scrimp, borrow and negotiate to get enough money to pay them all off. It took time and patience but I am happy to say "I DID IT!!" What an awesome feeling. I settled all nine accounts for $12,767 dollars with the exception of one account that worked out a payment plan with me for 0.99% for five years. Good luck to everyone out there who is trying to settle their debt! Now I will start working on repairing my credit. A new journey.
  3. I am in Maine. My last payment was around June 2009. How is settling the account for 40%? Is that a decent offer with a CA?
  4. As far as NCI, I did send a debt validation letter to which they never responded. NCO basically didn't validate either but said that they would refrain from any further collection on the account. These are my accounts and I owe the money. My problem is that I am trying to pay off these accounts and these are the collectors that I am being directed to by the Original creditors. I am not interested in catching the collectors in illegal activities, I simply want to settle my debts while I can. Any thoughts on the best and safest way to do that? The original creditors will not talk to me about
  5. The debts aren't that old, about a year and a half. The original creditors are GE Money and there is nothing new on my credit report as far as anyone else reporting the credit. Why won't the original creditor talk to me? They keep referring me to NCO and NCI which are third party debt collectors.
  6. I finally have funds to pay off (actually settle) some old debts as I don't have enough to pay the full balances. However, all of the accounts have been charged off and the OC's will not talk to me. I am desperate to get these debts taken care of. I have learned through this site to never deal with a collection agency but I am wondering if there are any good collection agency's out there and whether anyone has had any good experiences with them... This is one debt among many and I don't have enough money to pay the full amount owed on all my CC's but want to settle them for as little as possible. On 9/9/09 Encore Receivable sent me a letter on behalf of GE Money demanding payment. I sent them a letter on 9/16/09 asking for validation of the debt within thirty days.   10. I was sent a letter by regular mail yesterday informing me that I am being notified of a hearing on October 4, 2010 in small claims court. This is Target National Bank v. me. Obviously I know I have to appear but I have no idea how to prepare for this. They did not mail me any information whatsoever to respond to. Anyone else been served like this before? I have been fighting with Citi on a similar case but we filed discovery and arguments and so on and still don't have a court case. Any help is greatly appreciated.   11. HERE'S THE GOOD NEWS. if you do get an arbitration award RENDERED AGAINST YOU, you can STILL NEGOTIATE PAYMENT BEFORE ITS CONFIRMED AS A JUDGMENT. If you do that...and prevent confirmation, as a judgment, by payment arrangements, it will not appear as a judgment and saves your credit from a public record. (Arbitration awards are a private matter and is not subject to public record reporting on your credit report, unless the public confirmation of award takes place and is granted in court.)   12. I have elected arbitration and have sent in my paperwork to AAA. If I lose in arbitration, is it going to reflect as a judgment on my credit report?
  13. I am being sued by Citi. I am considering filing with JAMS but am scared to death. I am afraid that if I file with JAMS and I lose, I will have to pay the fees for JAMS. I have no real "case". I owe the money. I am in essence just buying time. Should I file JAMS and pray for the best or should I file with AAA which doesn't require the loser to reimburse or try to get the attorney for Citi to settle? She is very difficult to deal with and hasn't budged on anything. (The amount is about $3000.) The court date hasn't been scheduled but I have until May 30th to file any discovery documents.
  14. Do I need to file a counter claim first or should I send my arbitration letter and then counterclaim if they try to argue I can't elect arbitration?
