  2. Unfortunately I didn't have any exemptions to claim. I've heard that some hardline lenders will approve you if you have a letter from the trustee providing permission for you to apply. I was also told that my new income is not part of the estate and not an issue. I was going to go for a $7000 loan and pay it off in full by the end of Feb. 24% sux but not having a vehicle sux worse.   3. My car was repo'd 5/31. I filed Ch 7 on 6/17 and I'm having a really hard time without a car. I am partially disabled and the buses are killing me, not to mention a 4:30am wakeup to ride them for 2 1/2 hours to get to work. I was joyfully offered a great job this week. YAYYY!!! How best to approach the trustee about buying a car before the 341 meeting? I would have to finance a 5-7k semi-reliable car for about 90 days and then pay it off.

  5. What if the last Dept. of Ed loans you need to finish your degree are already approved? Can't you include those amounts (the account numbers are the same, only the semester date changes at the end), when you file your paperwork? I want to get my Ch. 7 filed but the funds for 2011-2012 won't begin to be dispersed until Sept. 1, 2011. Basically, the debt is already incurred.
  6. Please help me clarify a couple of points before I finish up my paperwork. My daughter, son-in-law and baby granddaughter all share a nice rented house here in VA. Together they make about 90k a year and qualified for the lease on the house on their own but the property manager asked that my name be added to the lease since I would be living here too. Will I need to use the Schedule G-Executory Contracts and Unexpired Leases page? They have been wonderful to cover my portion of the rent and utilities and I take care of the baby and the house until I can find a job. Cash does not change hands. How do I handle this? I'm not sure how to put it into the paperwork that I don't have a monetary obligation for housing. Thank you.
  7. Well, I gave Methuss' logical advice alot of thought. But although my credit reports are supposed to be frozen, EQ and EX have each added 5 new medical trade lines adding another 5k. I have gone the rounds with each of them twice before about this evidently to no avail. I just really need a fresh start. My priority right now needs to be getting a good job. I don't even have the cash for all the CMRRs it would take to keep the fight up. At least I know CIC is here-thanks.
  8. Nope, neither one. Since my reports are frozen I don't worry about them much accept to check Truecredit once in awhile to see what the tradelines that are already on there are up to. The judgment was entered in June of 2009 by Mann Bracken on behalf of Dell. I'm pretty sure it's past the SOL in VA of 3 years too but I lost quite a few records when I moved from CA to VA (which is why I scan everything now). Should I give MB a chance to pull the judgment off my reports before I ask for it to be vacated and then sue them for the stain on my reports?
  9. How does a judgment "show up" on your reports? Isn't the court supposed to notify you that there's a hearing so that you can be in court if you want to?
  10. Thanks for putting that into perspective folks. I love listening to Ramsey. He's an absolute genious, the way he comes from a gentle perspective and still gets his point across instead of beating up on people. With your help I've decided to work on my tradelines from a statute of limitations and "prove that the date of last activity isn't 7 years old" standpoint. It just might work.
  11. Thanks, Methuss. My main concern about the condition of my reports is that I cannot rent on my own. I'd like to be able to move back to my own place when the lease is up here. I'm thinking that if I file now the BK has some time to age before I try to apply for an apartment. On the other hand, I have been actively seeking employment since the middle of Feb. and have applied for almost 150 positions. I'm normally in the 45-50k salary range. I could be employed this week or this could drag on for who knows how long. People my age are not being snapped up right now. Does this change anything? I really respect the expertise of the folks on this board.
  12. Hello to everyone...glad you're all here! I'm finishing my education late in life and have 2 semesters to go. I have $25k in student loan debt and will be borrowing more for the 2011-2012 school year. I will have about 14k left over after tuition, fees, books, etc., half of which will be dispersed Sept. 1 and the remainder the next semester. That said, I need to file Chapter 7 and start over with nothing but the student loan debt. There is approximately 20k in miscellaneous debt on my reports-medical, cc, consumer, the SUV was repossessed last week. I have nothing except a cat and some furniture and a checking account with $4.21 in it. I've been unemployed for the last 9 months to help out with family issues. My daughter and son-in-law and I rent a house together and I've been the baby's nanny since she was 6 weeks old. My rent has been offset by my nanny salary for the last several months. My reports have been frozen since the day it was legal to do so so they wouldn't get worse than they already are. It has worked well. Can I file for bankruptcy while still using financial aid? When should I and can I file? I'll be going pro se, I can probably even get the courts to waive the filing fees.
