  1. Thx Olsker. Regarding the contract, I honestly don't know what it says. Mediation wasn't really expensive. Maybe I should just be happy that I am the victor and let sleeping dogs lie!

Also hoping someone can answer my question: I went to mediation several months ago and I had to pay half of the mediator's charges. Can I file something for that cost since Midland dismissed the case? If so, I want to make sure I do it in a timely manner.
  3. Thank you Wolfman! The suit was filed in Superior Court. I didn't request meditation. It was Court ordered. I had to pay half of the Mediator's charges. I didn't have a choice. If you will post a thread with your questions, there are loyal members here that give you advice that may help you out. Good luck!
  4. Coltfan, there is one more thing I would like to add. We never exchanged discovery! That process never took place. I was preparing for a default judgement against me. However, armed with what I had learned from this forum, I did go to mediation and tossed around a couple of things that I had read about here i.e. material facts and lack of standing! That may have tipped them off that I was at least doing my homework. And the fact that I paid to go to mediation and refused to make an agreement with them without proof that they even had standing to sue me. Another thing that I learned here, that I didn't have to settle for anything, especially an alleged account that I had absolutely no proof if it was even mine or not. I'm just grateful beyond words for this forum. I would like to know if I can recover my cost for mediation, if anyone can advise me on that?

  7. Without prejudice but it's still a dismissal! Please allow me to briefly babble. Court was scheduled 3 days ago and I had heard nothing from the Plaintiff so I assumed that this was it, that dreaded day had finally come. After two years and two continuances I was concerned though because both of the other times, I received a letter notifying me of a continuance, but I didn't get one this time. I have been keeping up with the docket online via the clerk of superior court website and the day before court I noticed they had changed the calendar call date to another time. That was odd since I hadn't been notified of anything so the morning of the court date, I called the courthouse. The lady that I spoke with told me that I needed to come on since it was already scheduled. I asked her if it was possible that they had got another continuance and I explained to her that they had changed the court date on their website. She told me to hold on. I could hear her asking another clerk, I'm assuming. She then informed me that they/Midland did have another continuance. So, this was the supposedly the third one! I didn't check my mail yesterday but today there was a letter from Frederick J. Hanna & Associates, P.C. postmarked the same date as the scheduled court date. I figured it was probably a late arrival of notification re: a continuance. I was shocked when I opened it and saw a NOTICE OF VOLUNTARY DISMISSAL. Thank you GOD! This is literally a Prayer answered. I am so relieved and happy to lay down this heavy burden. The Court hasn't updated the website yet from continuance to dismissal but I have the written notice so it's all good. I am so very thankful for this forum. The people on here that are dedicated and come here with sincereness to help others like myself, you all are a Godsend. I wouldn't have known how to even file an answer had it not been for this forum. This is the place to find guidance, reassurance and a great source of enlightenment. I truly didn't know who these junk debt buyer's are and what they're all about. Thanks from the bottom of my heart to all that have helped me. God bless. I do have one question. I went to mediation several months ago and I had to pay half of the mediator's charges. Can I file something for that cost since Midland dismissed the case?

  9. Thank you MustangGrrl! I really hope this post doesn't prevent me from getting help here when I need it since people have been so helpful already it but I have to admit to you that I still have not mailed off my discovery responses. That was the reason I came to this forum in the first place was because I had failed to do that from the beginning and didn't know if I should even bother to do it. I was working so hard on getting it all together and I am about half way finished but seem to just hit a brick wall. I still have to put together my discovery for them. I think I just got so overwhelmed & some days just feel like throwing in the towel and just not even go to court but I know for sure what happens if I don't go! I have learned so much more than I knew by coming to this forum tho and I want to fight this. I think I'm more afraid of myself. I want to do everything right and I don't have enuff confidence in myself. I keep telling myself time is running out to cure this defect of not finishing up discovery and I have got to go ahead and just see what happens. I still have 3 months before Court is on the calendar again. They've already got two continuances. Thank you so much for your post! It helps alot to know that people care. I'm going to tie up my shoe laces and get back in the game. I need a good kick in the butt. I will post everything I plan to send them very soon if anybody cares to look over it. I feel guilty for dragging my feet but I read over and over this stuff everyday and am so grateful for the people who take the time to help people like myself.

  11. I don't sign in everytime I come to this forum which is usually everyday but the posts that I enjoy the most are the ones that say "I won!" It really lifts my spirit and gives me courage and hope that one day I can make the same post.

  14. Ok, i'm a little, well, alot dense and scattered tonight! Exactly what is the non smart rear way that I should go? I think I know what you mean tho! & not sure I would want a three ring circus. I would most likely be portrayed as the clown! And they're the one's that threw in S.S. as a defense and put it in the admissions. I'm still confused tho. In the admissions I answered: You do not have any legal or factual basis for your defense of Social Security with "DENIED." If I withdraw that defense in the interrogatory, wouldn't I have to change my admissions answer? Or object to it? Same with "unjust enrichment," assuming I follow legaleagle's examples for that interrogatory above then I would have to change my admissions for this one too. Am I right or wrong? Hope I'm not too confusing on those questions. I'm so grateful for every response!!! I can't say it enough.
  15. I"m lovin the humor. I wish I had the nerve to answer with these excellent answers! I love this forum. It's become my peace of mind. I just got home from spending a long day and night at the hospital with a very close family member. Looks like yet another stressful set back for me but I will continue to work on putting this together between hospital trips the next several days. I know i'm all over the place but I have another question. If I withdraw the Social Security and Unjust Enrichment defenses, shouldn't I change the admissions answer for both of them? I can provide proof of S.S. & didn't list it as a defense to begin with. & maybe just object to unjust enrichment or go ahead and withdraw that defense too?
