  1. well I was wondering the papers I got from the plaintiff claim that I have 30 days to response properly to the discovery from the date from the paper, but their is no date or signature from a judge should I wait a while to see if I get anything that is ordered by the court? I plan on going ahead and rewording my discovery. Is there a way to object to something, without stating an objection, such as Defendant denies...........? I will look more into this. Also my hearing was about my objection to their interrogatories which the plaintiff sent me in discovery. So since my hearing was suppose to be about the interrogatories and since i was unable to make it to the hearing, does that give the plaintiff to deny by objection to everything I objected to ?
  2. Hey everyone I received this Order denying defendant's objection to plaintiff's discovery in the mail today. I guess the Plaintiff's are sending this to the court to have it signed/stamp by the judge. Because the one I received doesn't have a date or signature on it. The reason this came up was because I have a hearing that was suppose to discuss my objection to the Plain tiff's Interrogatories, but I was unable to make the hearing due to some family issues. Any suggestions of how I should go about fighting this one out? I have posted what I sent to the Plaintiff's in respose to their discovery request in other post. They want me to basically responsed with a admit or deny on my discovery response

  5. Ok. Everyone thanks for the help this far. Here is another question. I just got my answers to the interrogatorries notarized. I notice that the notary put my driver license number on the both of where it is notarized. Is this a big deal?? I believe that is used to authenticate who signed what if I'm not mistaken
  6. So would it be best just to object and also deny because I have already denied requesting, being issued or using a credit card?

Well this is what the Florida Rules of Civil Procedures state about request of admissions: Rule 1.370 The matter is admitted unless the party to whom the request is directed serves upon the party requesting the admission a written answer or objection addressed to the matter within 30 days after service of the request or such shorter or longer time as the court may allow but, unless the court shortens the time, a defendant shall not be required to serve answers or objections before the expiration of 45 days after service of the process and initial pleading upon the defendant. If objection is made, the reasons shall be stated. How I understand it is that the matter is admitted unless I serve to the Plaintiff a written answer or objection. Is that how it sounds to you guys?
  8. BV80 and everyone this is the one request on the admissions that has me. It states: Every time i utilized the credit card issued to me by the Plaintiff's predecessor in interest HSBC it was my intention to repay the Plaintiff's predecessor in interest HSBC for the charges I made. Now I know if I admit that, that pretty telling them yes I did have a card and used it. But how would it look on me if I denied it, which I plan to do? I mean it sounds like if I deny like its saying that yes I used the card, but didn't plan to pay it back. Should I just put this. Defendant denies ever requesting, being issued or using the supposed credit card?

  11. BV80 you said 21. They're asking if you ever disputed. I would simply answer the same as #17. But, 21 just ask more my address of the past 5 years. By them asking for my address are they asking if I ever disputed the debt?

I was wondering if you guys would look at my answers and tell me if they sound good enough. I mostly took legaleagle advice. I wanted this to look right before I send them off. I want the Plaintiff Main Street Acquistion to know that I'm bring my game and not backing down from a fight. So I want to make sure my answers/response/objections are proper, so any help or advice should be great if i should make or not. Indicate the following information that you gave the Plaintiff's predecessor in interest HSBC to obtain a credit card when you first requested the account from the Plaintiff's predecessor in interest a. your residential phone number b. your employment phone number c. the amount of income you earned d. the name of your employee e. the name of each person you wanted a charge card to be issued to on the account? f. your social security number and date of birth?
