  3. That's it! Above are all of the documents I sent to the Plaintiff in my lawsuit. I'll come back and clean up some of my posts later probably tomorrow (I'll also add the Admissions questions I was asked so you can know what I was saying Denied to over and over). But I just wanted to add a couple more things as tips before I go for the day. When you copy and paste into your Word Processor make sure that the " quote symbols " that you are using actually match the quote symbols that you copied & pasted. (Just a pet peeve, but it also lets the person know that you didn't write that portion).

  7. Ok, next up Motion to Compel Further Documents. This "Motion" is comprised of several separate documents & your "Exhibits" - but the entire thing is sent together with one Proof of Service, CMRRR. My Proof of Service for my Motion to Compel said exactly this: "Notice of Motion, Motion to Compel Further Response to Demand for Identification and Production of Documents, Memorandum of Points and Authorities, Declaration of MY FULL NAME, Defendant's Separate Statement in Support of Motion to Compel Further Responses, Exhibits A-G." So that is 1 + 2, 3, 4, 5 documents and then the Exhibi
  8. They didn't respond to the first Meet & Confer letter, so I waited about 3 weeks and sent a new one. Unlike me, you should be already working on your Motion to Compel if they are not responding to your letters, there is a deadline to Motion to Compel on Request for Documents (it goes quick, is it 45 days? Ask someone, i can't remember how long), so get your butt working! I had to do mine with the help of HELPME (there is a god!) and it took a week & really sucked to be on a time deadline! So, after I sent this, I ended up receiving a bunch of BS from them (please see earlier in my thread, I detailed the "stuff" when it happened), some internal call log, a generic bill of sale, a self-created "Schedule A" and a Citibank card agreement circa 2007. All of these things together = them not answering my Request for Production, don't be shocked or dismayed, BE HAPPY! So, then you send them a Meet & Confer letter. Calawyer suggests putting the letter in the format you are about to see, because when you do your Motion to Compel, your "Separate Statement" is basically exactly this

Next Up, I sent the Plaintiff some discovery, a Request for Production of documents - read calawyer and find out why its smart to keep these short - you can send out multiple requests, but if you send a boatload of questions, your Motion to Compel will be a MONSTER, so don't.
