  1. I want to thank everyone that responded to my thread. I went ahead and went to a lawyer to get my bankruptcy started. I am ready for a fresh start.
  2. Been busy at work and almost forgot about posting the info. Count1 open account Damages that dont exceed $5000 Defendant purchaged various and diverse counsumer goods Defendant failed to pay balance Defendant owes 4706 Count 2 account stated Plantiff repeats and realleges the allegation of paragraph 1&2 Before the institution of this action Plantiff and Defendantt had business transactions between them and them agreed to the resulting balance Plantiff rendered a statement of account to Defedant and Defendant did not object to statement Defendant owes plantiff 4706 that is due with intrest according to the attached account ( last statement copy attached) Wherefore, Plantiff demands judgement against defedant for damages of 4706 and any futher relief this court deems just and proper

  4. I thought that was a no, no. If I get a default they can come after my bank and pay check, correct.
  5. I am going to my lawyer to get a definite answer but I was told I can do the bankruptcy why still in foreclosure. I didn't have to be done with the foreclosure to include it.
  6. I just got a notice to appear by a lawyer from Citi Bank. Now I am in the process of a forclosure and will file banckrupcy after the forclosure is done. I was going to add all the CC that I defaulted on also. What do I do or say when I go to court on 10-24? Thanks
  7. Thanks for the response. Why would they go with AAA, I only sent them a DV letter and nowhere did it say I elect a arbitration? Also in my citi agreement it says ""Each party will bear the expense of that party’s attorneys, experts, and witnesses, and other expenses, regardless of which party prevails, but a party may recover any or all expenses from another party if the arbitrator, applying applicable law, so determines." Can this happen? Does it happen? That would expensive. Now if I understood you right, I should go ahead and start the JAMS paper work? Don't even send them the simple letter stating I elect arbitration to resolve this matter. Thanks
  8. Ok I just saw that since its not in the courts yet I should just send a letter electing arbitration. I saw this on your second post of this thread. I also saw that you wrote "that is a great time to elect arbitration "if" you know that you have an agreement that would work the way you want". Pardon my lack of intelligence, but what did you exactly mean by this. Thank you so much for all this info you are providing here.
  9. Linda7, another member pointed me to this thread. It is great reading and great step by step by step instructions. He's a quick run down of my situation. Citi Bank N.A. Represented by a local lawyer Debt 4700 Lawyer sent me a letter letting me know that they represent Citi on he debt. I responded to the letter with a DV letter with no election for JAMS. Then they sent me verification. Now here is where I am little confused on what to do next. Should I send them a simple letter telling them I elect arbitration or do the whole JAMS paper work and send that.

  11. The amount on the CC statement they sent me is the amount they are coming after me for. It is a Jan.-Feb. statement. I believe that around the time I defaulted on the account, but not 100% sure.
  12. I know the fealing, I am other boards where this same thing happens. I am new to this board and plan to be around. Not to give advise, because I have none or have had this happen to me before, but rather to take in as much info as possible. Due to unforeseen surcomatances I had fallen into debt problems. My first one being Citi Bank. At this point I have gone over this problem in my head thousands of times. Should I fight, should I settle, should I hire and attorney. This is not something that I wantted to happen as I was doing just fine, but like MANY people, my economic situation lead me to this. Hopefully I can get this resolved and share my expirences with others. Like I said this I my first one, I have more that I don't dought will come, my main one being my home, but that's with a lawyer as that is a big deal to me and to much for me to handle. So far I want to thank those who have at least look and responded to my thread.
