  1. So, Obvisouly I need some advice asap. My wife and I are in the process of buying a house. When the mortgage broker pulled up our credit report, it stated that there was a judgement against my wife. Well, we were shocked, of course. Beucase we never received a commons. the problem is, is that we lived in new york and moved to Pennsylvania in 2011. When we checked the court documents online, the summons and judgement were issued in 2012. The company suing us is CAVALRY SPV I, LLC. On the compliant submitted by Cavalry to the court, it does not mention any account numbers or anything else. All
  2. I asked for advice, and instead I received someone's negative unhelpful comments...therefore I have decided to delete my post.
  3. Hi everyone! I was served about 25 days ago by CACH LLC. Originally, I thought that the collection on my credit wasn't mine, so I disupted it and it was deleted. . I was able to hire an attroney that will send them a letter as a response to the judgement. He doesn't think that he can win alleging lack of standing or proof that I owe the debt. He thinks that he should pursue the SOL defense more. The original creditor was Bank of America (allegedly), the terms and conditions were likely from Delaware. My attorney thinks that he can get this case dismissed because that the agreement
  4. Looking for recommendations on what to do. My spouse foolishly signed a complaint against her for $2500 or so without looking into what she should do first. She has no job, no income and absolutely no prospect for work. The lawyer that file the complaint against her knows she is judgment proof but has attempted to take my state tax return for the last three years. As my wife has no income, the tax return was awarded to me. But now I believe the lawyer is going to attempt to take our (my) checking and savings account monies because her name is on the accounts. Any suggestions as t
  5. Good afternoon all. I made a major mistake with taking out a personal loan with a company based out of Idaho, and I need some advice. I took a $1500 loan back in August 2013, and was making payments every two weeks. Everything was fine until the government shutdown in October 2013, and I lost nearly a months worth of income(I'm a contractor). I explained to them my situation, and they were less than helpful. I got behind on my payments, and they were threatening to take me to court. In the end, I ended maxing out one of my credit cards to take care of the daily accuring interest, as well a
  6. Hi there, A few years ago I was sued by a creditor. I was young and dumb and didn't attend the hearings. I never received anything from the court stating that I had a judgement (that I can remember - this was in 2009). I did receive a letter from the creditor saying they had a "judgement". I had no ability to pay at the time and no assets. Nothing ever came of it. Nobody has tried to collect, garnish wages, etc. I haven't even heard anything from them (or the courts) since that time. Fast forward a few years, I am more financially stable. I would like to find this judgement (if it even exits

  8. Yesterday I was about to call a debt collector to offer them a more lucrative settlement than I was able to offer last time I talked to them. A little voice told me to check the courts website for the county I used to live in, low and behold they sued me, submitted proof of processing, and got a judgement against me because I never responded the the summons that I NEVER received. I called the courts and the clerk told me the plaintiff served a 5'3" Caucasian female with brown hair, approximately 30 years old, at my friend's address in California in April 2013. I was having my mail sent to my f
  9. I have a judgement that was filed against me on October 17th 2007 in the state of Florida. It was filed by an attorney for the OC. The judgement is for $7,104. I have obtained copies of the judgement. I looked for errors, but was unable to find any. Everything is correct(First Name, Last Name, Amount) it does have an old Florida address, which was removed from all of my credit reports. I was able remove the judgement from one credit report, but it keeps coming back as "verified" with the other two.bureaus. I now reside in Texas and would like to buy a house as soon as possible. 11. I recently received both a Garnishment of Wages summons this month, as well as notice from my employer of the garnishment. a) the Summons was served to an old address (my parents house) in another county I was never served for the original judgement hearing. I found out where the original judgement venue was, and informed the clerk I was not served/notified. 1) Clerk stated that a summons was sent to my parents house in 2008 (I haven't lived there since 2006). She stated that i could file a Motion to Rehear on the grounds that i can prove that i resided at a different address (wh
  12. Okay, I've been slowing getting my personal credit together and I have a few of curious ones. 1) I have a rather large judgmeent for $9000 (with interest its probably almost 12000 now) that I got in 2011. I do owe it and all the service and everything was proper. I set up a payment plan for $200/month that's documented on the docket with the courts that both the attorney and myself agreed to it. I can comfortably pay the payment plan but with the size of the judgement and the interest on the judgement, it would take me almost 15 years to pay it back and I would pay $16,000 in interest alo
  13. I am having the exact issue with the same law firm: Received a Notice of Claim/Summons on Saturday 2/23/2013 stating, The said plaintiff complains and says: That the defendant is indebted to the plaintiff for reasons stated herein for unpaid balance due. (Plaintiff being Midland Funding LLC as assignee of Citibank). and asks for judgement $$. I received via regular mail and the service requested was personal. (Not sure if this matters). Attached to the summons was a letter declaring I wasn't active military and an affidavit of debt. Affidavit of debt reads as follows: (Also not noto
  14. It never ends. As much as I try to clean up my credit, things keep pulling me down. So I was notified today that my state refund was taken for something else. I find out apparently it's from tuition at state college from 2003. My parents were paying for my school at the time. I have no idea where this came from and what to do. I've contacted my parents but I have a few questions. How can they get a judgement for something that is 10 years old? This is not a student loan, it's tuition debt. Also, I can't see how the money could be owed. I was always under the impression that if your bill was
  15. I am really confused about this topic. There was a tax warrant placed on me for less than $300 for something that I was unaware was happening. It was an innocent mistake. I paid it immediately and sent a letter to the NY tax correspondence department. I then followed up today (3 weeks after I sent the letter) and asked if there was somebody I could talk to in order to have the warrant vacated. First he told me they only did that if the warrant was placed in error or if I paid it before it was placed. I paid it about 3 days after and was unaware it was being placed it was for around $300. So

  17. I was sued a couple months ago by a debt collector for unpaid credit cards. and hired a lawyer who said would take of it and would contact all the creditors to settle my debt (I paid the lawyer). However a Default judgement was granted against me and a different Credit Card case is about to be judged. I just received a letter that i'm in default for not responding personally or through a lawyer, who said he has entered on my behalf!! I don't know what to do. I've already paid my lawyer, but it seems like he's not doing anything. Its been almost 3months and all he says he hasn't received any re
