  1. I came across this forum. I started this thread to update and show the progress and or outcome of the case. I haven't been summoned yet. But I have a friend at the clerks office who called me and told me someone filed against me. Sure enough I am being sued in small claims court for 5900.00 Which doesn't make sense to me because the limit is for 3000.00. My orignal debt was 5900 not including interest. The debt is credit card debt and is recent a few years old. I am not sure what my next step will be. I guess I have to wait and see . REading this board has put me a little at ease. Thanks fo

If you reside in Tennessee and you have received a dunning letter from any debt purchaser attempting to collect from you, [be advised] Asset Acceptance is on a tear throughout Tennessee as is Midland Funding, LLC. The latter "usually" sends a letter first through Midland Credit Management before suing through Midland Funding. CACH, LLC is always active as is Cavalry SPV I. That said, these matters are not that difficult to get dismissed but they do require your attention.

  4. Was sued by Asset Acceptance in Columbia County, Oregon for a Time Barred Citibank Credit Card Account in the nominal amount of $5000.00. (Two weeks after their FTC 2.5 million dollar loss and their agreement to not file time barred suits in the future) Went through the Court Adjoined Arbitration Process and prevailed having the lawsuit dismissed with prejudice by the Arbitrator.   12. Ok so I guess they didn't want to fight. While that is great news, I really wanted to show up in court with them. I know I must be crazy, but I was looking forward to attacking their evidence in the court room.   13. So, there was no contract attached to my summons as required by Illinois law. I filed a motion to dismiss in lieu of an answer based on that, the judge gave the JDB 21 days to respond. I will be going back to court soon. Anything I should bring with me? An answer perhaps? The Judge told them they had 30 days to produce the original contract so I will keep my fingers crossed, they did not produce it in Interrogatories and have not to date.   16. I recently recieved a phone call from Fulton, Friedman & Gullace saying that they were representing Asset Acceptance for a Citibank Card under my name. I was told that I needed to make payment arrangements immediately and that a court case with the number 12345 had already been opened at our local county courthouse. I informed the representative that I did would not deal with anyone over the phone or agree to anything without seeing everything in writting.   18. When I was in college I was stupid with credit cards, I opened 2 $3000 limit CitiBank cards and maxed them out with no ability to keep up with payments. I was young and stupid! I defaulted on them and they went into collections in 2006. I finally have a job that allows me to beging paying these debts back. I was making payments on one account that began at $3600, got it down to $2500 before they started dicking me around on the other account.
