  1. Ok so call me naive but back in 2005 I was harrased by the company Asset Acceptance. At that time I was told that it was for a credit card debt. I ignored them for a while and then got threatening phone calls that told me I had to pay them or else they would go after my house, ect, ect. You all know the tactics that they use. So I told them that I would send them a cashiers check for $1500. They said that they wanted $2000. I insisted that I only had $1500. We went around and around for a while until they finally said "ok, go ahead and send the $1500. So like an idiot I did. Thinking that it
  2. Anyone see any glaring issues with the request for admissions from articles they said they would produce at or bewfore trial!! Thanks REQUESTS TO ADMIT FACTS The Defendant requests that the Plaintiff answer the following requests to admit facts pursuant to, and in accordance with, Federal Rules of Civil Procedure 36. 3. Hello, and thanks in advance for the help. I have read a lot of the posts already and it has really helped me on my way. I only have a couple more days to respond to the papers served upon me re a suit by Asset Acceptance. I was wondering a couple of things: 1) I have prepared a BOP to send certified mail return receipt to the attorney for Asset. I literally copied it straight from one of the forums and just wanted to make sure it looks OK before I send it tomorrow. It looks like this: Bill of particulars My Name My Address My Phone SUPERIOR COURT OF THE STATE OF CALIFORNIA FOR THE COUNTY OF
  4. Quick question, I have a pre trial next Tuesday with ASSet Acceptance, we have already exchanged interogatories, and in looking through the Michigna Rules of Civil procedure i may need to file my motions at the pre trial....Does that make sense or sound right
  5. This is from the $2.5 million law suit the FTC filed against Asset Acceptance. Can someone please clarify what would be considered "parking" debt on a consumers CR? -jdb purchased debt 2/2011 -jdb reports debt to CRA'S 2/2011 -jdb admits to allegedly sending DV notice 3/2011 The order also prohibits the company from: Making any material misrepresentation to consumers and making any representation that a consumer owes a particular debt, or as to the amount of the debt, unless it has a reasonable basis for the representation. To ensure it has such a basis, the order requires Asset Acceptance t
  6. Questions regarding a warrant not served. Received letters from attorneys who represent debt clients desiring to help that stated court docket#. It prompted a call to the local court of general sessions to verify if it was legitimate. Found it was and there is a warrant out there but not yet served and subsequently no court date. The questions I have, after investigating further, is this is from Asset Acceptance JDB. The actual debt last payment activity was 11/2009 in the state of NC (SOL is 3 years there where debt occurred). I'm in TN and SOL is 6 years. Which SOL will they go by? What ri
  7. I am being sued by Asset Acceptance in Nebraska for around 2k. The SOL in my state is 4 years and my last payment made was supposedly in May of 2009, which I found weird because the account closed in october of 2008 and it is supposed to come off of my credit report in september of 2015. Anyways I am wondering what my first step should be, I know I don't want to just pay them the 2k and I'd like to at least settle. How do I fight it? What should I file? Any help you guys can give me would be great.
  8. Hello. I had a complaint filed against me in Ohio from Asset Acceptance in small claims court. I filed an answer denying their complaint and asked for the case to be dismissed with prejudice at the plaintiffs cost. The case was set for a pre-trial hearing which was today. I went for the pre-trial and sat down with the attorney they contracted. He first asked me if I ever had a Best Buy card. I said I'm not answering your question. He then presented me with settlement options and asked me again if I have a Best Buy or HSBC credit card in my possession. And if I still have the card, etc.
  9. I am in dispute with Asset Acceptance Inc. They are the third debt collector to retain this debt. The first debt collector to obtain this debt was United Recovery Systems; at this point Citibank still owned this debt as their letter requested that I send payment to Citibank. Their letters are dated December 1, 2009 through January 28, 2010. There was a total of three letters requesting repayment. The second debt collector was Capital Management Services, LP. With this company, Citibank still owned the debt as they are also requesting that full payment be made and the check written to Citibank
  10. I am being sued by Asset Acceptance and there legal firm of Fulton Freidman and Gullace from an alleged past due debt from HSC. I have answered the summons/complaint as well as served them with discovery questions, as they have me. We have a pretrtial court date set for November 20th, 2012 in Clinton County. I have been researching feverishly to help me get through this case, but now think I may have gotten in over my head and will get stuck. I have all of the paperwork that has transpired between ourselves and the court and am looking for advice and help. They supplied an affidavite of d

  12. Okay. I effed up. I can't believe I did this, but I marked the wrong date on my calendar for my Case Management Conference. I had it down as August 31st. I was just looking the paperwork over and noticed I'd marked down the wrong date. The CMC is scheduled for this week! Now, as you can see from my prior thread, I've decided to settle my case. This morning I dropped a certified letter in the mail to the plaintiff attorney outlining my settlement offer and also left her a v/m inviting her to call or write back with a response once she's reviewed. I think they likely would settle, but n
  13. My parents are being called every single day multiple times a day by Asset Acceptance for about a month now. My parent's don't speak English, so they just never ever pick up. That's their rule with unknown calls (if it's important they'll leave a message). They just thought it was political or telemarketing. They told me it recently, and I googled the company. That's when I found out it was debt collectors. I asked them if they owe anything, they don't. Neither of them have credit cards, and neither do I. I have student loans, but my grace period hasn't ended yet so it can't be that (just grad

  16. I don't know who these people aren never heard of them or from them and the only found out already because recvd letters from local attornys but I have not been served any papers. The "disclosure" section on my county courts website only shows its "undisclosed". I don't know who the original debt they are claiming was establised with or anything. This year has been horrific enough for me as it is. On eve of Feb 27th I went to my parents house to check on my 61 yr old Mom with whom her and I had been extremy close my entire life and found her unconscious & not breathing but still with a pul
  17. My wife is being sued by Asset Acceptance. I helped with answering the complaint, requesting a BOP, and a Motion to compel. The motion was denied and she is afraid to speak in court. We are looking for representation, but are wondering if it is cheaper to just settle. The debt is over $10k, but it is at least 3 years old. We don't know the last time it was paid and may be over the SOL. Does anyone know a lawyer in Bay Area, CA?
  18. Over 90% of their filings list Latino and Asians. I am very surprised at the number of Asians as Asians typically (I know this is a stereotype but it happens to be true) resist going into debt. The question is that if this indeed is the case, can anything be done about it? Here is a partial list of recent filings in San Francisco. I looked over dozens of cases and this pattern holds true throughout. CGC-03-421469 ASSET ACCEPTANCE LLC. ASSET ACCEPTANCE LLC. VS. MICHELLE WHITAKER et al Jun-17-2003 CGC-03-425961 ASSET ACCEPTANCE LLC. ASSET ACCEPTANCE LLC. VS. JEFFREY A FONG et al O
  19. I have another thread going, but wanted to break out this question to get addressed under another. So, I was served on 10/11/12 with a summons from Asset Acceptance. They are suing me for an alleged debt in the amount of $8600. I am in Florida. I went on the Clerk's website to find out more details about this suit against me and discovered that AA had originally tried to serve the suit back in October 2011, For whatever reason, the suit went unserved. So here we are nearly a year after the fact and I am served last week. So I go and review Florida's Rules of Civil Procedure and came ac
  20. (for more detail look at my other thread on my being sued by Asset) I am so ticked off right now at AA! I was able to locate my statement from Citibank and the account # listed on the statement does not match the account # that was listed on the lawsuit that ASSet Acceptance filed against me. (they only provided the last 4-digits, but none the less, they don't match the last 4-digits listed on the statement from Citibank) These guys are so pathetic! How do they continually do these sorts of things against people and still are able to remain in business! Haven't the courts and judges had enough
  21. This civil action is the same as pretty much everyone elses letters on here. Three pages the Civil action Hearing Notice, affidavit and the notice of who to contact at the courthouse. Im am reading through Coltfan1972 threads. My questions are. 1. This is a magisterial district court. When i called them they told me to bring whatever evidence i have with me what would this be? 2. Do i need to write my answer before i go to the hearing? 3. I'm a little confused about this but i just wanted to make sure i do it all right.
  22. Received letter from Asset Acceptance Recovery Services LLC stating that AA referred my unpaid account from Barclays bank to them for collection. Unless I notify them in 30 days to dispute the validity, they assume the debt is valid. My cc report shows where this company bought this debt. and then it shows where AA sold this account to someone in Warren, MI My last pmt was 12/2009 AZ Law What letter do I send them? A debt validation or a C&D? or??

  24. I really want feedback on this letter that I am sending to AA on monday. they validated my dv request and sent a cc statement, so I am terrified. Dear Asset Acceptance, I am in receipt of correspondence from you that alleges I have an obligation to pay you approximately $xxxx. I am afraid that I don't know who you are, and after performing a Google search on your company, I learned that if I don't pay you, you will take my home from me and have me put in a debtors prison here in Illinois until you are paid. Though I dispute that I owe you anything, I am prepared to offer a reasonable settleme
  25. Hi, I'm new to this so please bear with me & forgive me if I'm going about this incorrectly! I received a certified letter yesterday for a Civil Action Hearing Notice & I really, really need some help. I've read a lot of helpful things here but I really don't fully understand most of it. I lost my job back in March of 2010, have four children & a husband who is mentally ill & unable to work so I am not in the position to hire a lawyer. Juggling a lot of balls here & this is the last thing I needed. Padded room, here I come! lol Any & all help is greatly appreciated a
