  1. Does anyone have a current fax number for Asset Acceptance? I have about 20 and they are all bad. I know they change them frequently. Thanks in advance!
  2. Has anyone had a collections suit which was filed by one of the Managing Partners before? I figured that job usually went to a rookie. LOL I just noticed a claim was filed against me with Asset Acceptance being the Plaintiff. The Attorney that filed the claim was Kyle A. Cooper who is one of the Managing Partners of Green & Cooper.
  3. Just to keep the flow: being sued by Asset Acceptance in California. I admit I have procrastinated the BOP due to other stressors going on and wanting to put this on the back burner mentally. Served 7/28/12 filed a General Denial on 7/24/12, CMC scheduled for May 2013. This morning someone from their office left a voicemail formally requesting a "meet and confer". What is my next step? Should I send the BOP in response or do I need to call them back? I don't want to screw this up. So far they have sent me absolutely nothing. Their complaint was just a form they checked boxes on. It was unve
  4. I've been a member of this forum for a while now and am now ready to tackle the remaining items on my credit report. There was quite a bit of stuff on there but most of it has dropped off. All of the remaining items are credit cards. One item just showed up this month and I'm totally lost as to what it is. I would say that since 2006 I've owned and still have 2 credit cards that remain in good standing. So, I know for a fact that if the remaining items are truly mine they are without question past the SOL which is 4 years since I live in FL. Bottom line is it's either erroneous information in

  6. Recently on my husband's CR, there appeared a JDB we had never heard of before. It had been 4-6 months since we had checked his CR, and the TL had been on there apparently for about that long. I immediately sent a DV letter, but have heard nothing back as of yet. In the meantime, I checked their licensure in Florida. Guess what? Not licensed in Florida. Maybe that's why they did not send a dunning letter. Anyway, for the fun of it, I threw this out to an attorney who had been recommended to me for debt collection issues, one that turned my Asset Acceptance case down. She e-mailed me that she f
  7. This is my first contact with this Asset Acceptance for the alleged debt. An OC just sold the debt to them so I want to get off on a good start, unlike last time when I was sued by an OC right away. I'm going to send in my DV letter, should I keep it simple, or add to it and mention if there is a private arbitration clause, that I wish to invoke in now. Or should I just leave that out for now. I'm not sure how long until this debt buyer sues. Maybe someone can share some information about this collection agency, which I assume is a junk debt buyer. I was previously sued by an OC for a differen
  8. ABC Action News Channel 28, Tampa, called me today. The story about Asset Acceptance's $2.5 million fine and how I won my case against Asset Acceptance will air Friday, May 11, at 11pm. The reporter said the story starts out with me, then covers a lady from Clearwater, FL, (another victim of Asset Acceptance), who has an attorney, then goes back to my story, including showing my new book. He said the lady in Clearwater was going to fight pro se, but then decided to go with an attorney. He said now she has more problems than she started with. He did not go into detail. The story will also air o
  9. I've just been served. (guy came to door asked if "Slappy" lives here, I said no. He then left papers with me...I guess that's a good serve?) It says asset Acceptance is suing me over a credit card with bank of America. Looks like they bought the debt. Please help. I was laid off several years ago, have had no income. Could not get anything but a fast food job. Do not have a degree, worked my way up at a company before being laid off, then found out those qualifications will not help me get a job in this market. Went back to school, just started doing well, a year until I get a degree, living
  10. This is my first post so I'll try to be condensed and precise. I live in Texas, I'm disabled and at this time unemployed and receiving SSI. I have no debt with MCM. They claim that the debt originated with CIT Bank/Dell financial. I have never done any business with Dell or CIT Bank. This is a fraud/identity theft case. I've reported it to local law enforcement, the BBB, FTC, Texas Attorney General's Office, USPS, all of the CBs. This started when MCM sent me a debt consolidation offer in the US mail about 05/25/12, I turned them into the USPS immediately. On June 23 I received my free yearl

  12. Okay, I've been lurking for a while and when I found out about 2 judgements against me I was filled with rightous indignation and decided to fight them!!! the first was asset acceptance the second was Nco finanical. Both judgments were default judgments served and rendered in 2008 while I was living in CA. I returned to MI in 2011....... I found out about them after applying for a job and they did a background check. I file a motion to set aside judgment and went to trial on it and the judge set a trial for sept 12. But I have to answer them in 21days and they have discovery for 6
  13. In middle of suit with Asset Acceptance represented by Fulton, Friedman, and Gullace. Trial date set for Dec. Here is their response to my BOP "Preliminary Statement 1. The responding party has not completed either discovery or preparation for the trial of this matter. Accordingly, these responses are made without prejudice to this responding party’s right to present additional facts or contentions at trial based on information hereafter obtained and evaluated and are subject to such qualification, modification, or other substantive change as further discovery and investigation may indicate n
  14. Hi great people of this board. I have a few questions. I'm submitting an answer to the complaint tomorrow (CA). The demand is for almost $5k. I'm pretty clear on how I need to proceed just have a couple of questions. 1. The complaint does not appear verified. It's a lawsuit on behalf of Citibank but filed by Asset Acceptance. The attorney for Asset Acceptance just signed it with a computerized signature (it's a really bad gif lol) but there is no official declaration. In the first part of the packet there WAS a "Declaration Pursuant to CCP Section 395 (; venue for personal family or hou

  16. Hi all, Just found this forum and wanted to outline my case and get any feedback on strategy ,etc. This will be a long post so please bear with me. EDIT: I am in Utah ... jurisdiction may help. Pre Lawsuit In April 2011, I recive an initial form letter from debt collection law firm. The creditor named was Asset Acceptance (AA from here on), the Original Creditor was another collection agency. I had no idea what this account is. I respond with a standard validation letter. Law firm responds with another form letter with what looks like a screen printout that states nothing more than my name
  17. I am being sued by Asset Acceptance in California. I have "served" by them on June 25th and I have 30 days to respond, which I believe makes Monday my last day to file my response at the court house I believe. Everyone graciously keeps informing me to read previous posts to get help, but I have been reading for hours and have gotten no where. Any patience and help for me will be much appreciated. Here is where I am at: I have the summons in front of me, and I want to go the route of requesting this case be dismissed because the SOL on my Best Buy account is 4 yrs and I have not made a payme
  18. BACKGROUND INFORMATION: I received a "required to appear" arbitration summons in Illinois for a 5 figure amount + costs. SUMMONS INFORMATION There are three pages to this packet; the arbitration summons, the complaint and an affadavit from an employee of Asset Acceptance. There are no supporting documents attached. Therefore, THE COMPLAINT The plantiff claims as follows: 1. That the defendant , XXXXXX, is indebted to plantiff, ASSET ACCEPTANCE LLC by virtue of a certain agreement entered into by defendant on or about XXX, 2007; Plaintiff has performed any and all conditions required by the
  19. Today, I was served with a summons to appear in court for a debt that Asset Acceptance took over for Best Buy in the amount of $2,900. It seems Asset Acceptance hired a law firm in California to file this suit and they want me to appear in Dec. 2012. I was wondering if someone could help me with some options, considering how far this is along the way. I ordered a credit report today online, and I was wondering considering California's Statute of Limitations is 4 years, and that I have not paid anything on this for 5 years, can I still be sued over this? I believe Asset Acceptance bought this
  20. My wife had a BofA credit card that was charged off on 11/2009 and bought by Asset Acceptance on 10/2011. Her last payment was on 12/2008 and the SOL for this debt runs out on December 1, 2012. We have never responded to their phone calls or letters. A few days ago, my wife started receiving letters from attorneys in our area about assistance. I did a little research at our county court and found that on 06/26 they filed a lawsuit for "Breach of Contract", however my wife has yet to be served summons. There is so much information on what to do next it makes my head spin. Obviously, we will ans
  21. Hello all, first post newbie here. I apologize in advance if I violate any rules of conduct as my brain is filled with all the wonderful information I've read on here. Long story short, being sued by ASSet Acceptance for $1087 plus int costs etc for a credit card with 5/3 bank that's been charged off long ago, can't find the date. They filed suit in Franklin Co, Ohio and I've already sent in my answer along with request for production of documents, notice of service of interrogatories, and request for admissions. I will post these at the end of the string. Date of events from public record
  22. Won against A$$et Accept today in local court. Here's how it went. I got there 1/2 hour early to review my notes. A few minutes before my scheduled hearing a lady came up to me and asked if I was so and so. I said I was. She introduced herself as the attorney for Fulton, Friedman & Gullace. A$$ets hired guns. She wanted to know if we could settle for 1/2 the amount right then and there. I said I don't know what account you are referring to. She commenced to pull out documents and one in particular a bill of sale. No where on the bill of sale referenced the alleged account. Only that there

  24. Does anyone know if the Law Firm of Greene & Cooper is Asset Acceptance? I received a letter from an attorney at Greene & Cooper saying they represent Asset Acceptance, LLC. I checked Greene and Cooper out on the BBB and and under Alternate Business Names it says: Asset Acceptance LLC Anyone had any dealings with Greene & Cooper?
  25. I have mailed them VR as of 14 days ago. It is a B of A account that went delinquent 31 months ago. What might be expected to be available from the OC at this point? They file several lawsuits a day in this county. Of the only two case files I have been able to examine so far one was a default judgment and in the other the person didn't do VR until after they were sued and it is now in mandatory arbitration.
