  1. I paid a collection to an agency and autorized a check over the telephone. The check cleared in two days. Approximately six months later I began receiving letters stating the debt was still owed. I requested a copy of the cancelled check from my bank showing that the debt had been paid and to whom. To date, they continue to say I still owe and that my account had NSF, even after I provided them with proof. What do I do now?
  2. I need some help. I had a medical bill go to collection and I did the validation letter. The collection company came back to me with a computer print out from the hospital with just may name, address, and a list of all the fees. I have read the opinion letter from the FTC but I am still a little confused. This bill is mine and I want to pay it but I can't pay the full amount which is $400.00. I can only make $50.00 a month payments. I know that collections agencies want the payment in full. To make the story even worse I called the collection agency (even though you said not to) to see about doing $50.00 a month. They said fine but they would not put anything in writing. I just want to settle this. What should I do? Dispute the validation?
  3. I co-signed for a home improvement loan for $15K in 1990 with my father and mother with them being the ones paying. The investment property to which this loan was for was foreclosed on in 1994 which last year came off my credit. My father declared bankruptcy in 1997/98 and the debt for this $15K loan was put on my credit as a bad debt in September 1998. The loan was originated in Delaware from Delaware Trust. Delaware Trust sold to First Union who sold to Wachovia. A collection person is trying to collect for $17K. I told them that the statue of limitation is 3 years. They indicate that Wachovia is not in Delaware and does not have to follow Delaware rules. Is this true? What is the SOL for this loan? I sent a validation request letter this week with SOL claims in it. Haven't gotten a reply yet.   4. Ok back in june i got a collection notice form a attorney. I sent off a valadiation letter. While in todays's mail I received the following letter from them Dear Mrs Herbst You were previously advised by this office in writing that we were retained to attempt to amicably liquidate the above claim. At that time we informed you that we were representing PHOEXNIVILLE EYE CARE and requested that you contact our office. As you are fully aware we have failed to receive your response, which indicates to us that you donot wish to resolve the matter amicably . We would Again liek to stress that our cleint would be willing to recomment any reasonable offer yada yada yada.The above letter is dated 7-9-2002 and along with this letter is the 2nd page of the valadation letter that askes the questions 1. original creditor's name which says P 2. name of debtor which they have my name 3. and my addy 4. the balance is blank 5 date you aquired this debt 5-10-02 and that it was assigned. 6, and that they donot report to credit bureau but along with that notions its say i must call Ic Systems. Now my questions are 1. why do they have the notion about ic systems 2. I would think that they are in voliation of the Fdcpa since to me they are still trying to collect on this debt without valadtion? 3. And how can they say that i failed to respone to their 1st letter when i did responed by asking for a valadtion? I'm gonna assume a second stronger lette should go out? aLSO
  5. This CA got first validation letter from me June 12. Resonse consisted of a computer printout. They got validation #2 on Jul 10. This is their response (please try not to laugh, choke, pee or vomit)! CAPS ARE THEIRS! "YOU HAVE PREVIOUSLY BEEN PROVIDED WITH THE ITEMIZATION IN COMPLIANCE WITH FDCPA. IT MAY NOT MEET YOUR REQUIREMENTS; HOWEVER, THE ITEMIZATION OF CHARGES IS THE ONLY VALIDATION REQUIRED UNDER FDCPA. NO SIGNATURE IS REQUIRED AS YOU ACT UNDER IMPLIED CONSENT WHEN PRESENTING FOR MEDICAL CARE WHICH IS WHAT YOU DID ON XX-XX-XX AT XXXXXX XXX MEDICAL GROUP. MEDICAL BILLS ARE OPEN BOOK ACCOUNTS AND CONTRACT LAW DOES NOT APPLY. ENCLOSED IS ANOTHER COPY OF THE ITEMIZATION OUTLINING THE SERVICES YOU RECEIVED. I may not be a lawyer, but I believe this is a bunch of BS! Any thoughts? Calawyer: What do you think?
  6. Any suggestions on where or how I could find out if a CA is licensed to collect in Pennsylvania? Also, if I discover that they are not licensed, what then? As always, I thank you for your assistance.
  7. Does anyone know if it is significant or not if a collection acct shows no "date opened" date, just a "date of last activity" date. In my opinion, it means that they have nothing to show when this account was "supposedly" opened, just a date that it was bought from the OC. I keep reporting this account as not mine but it keeps coming back verified. But maybe I can dispute as "incorrect information reported" and get it removed on that basis. Has anyone come across any similar situation in their credit report? Thanks
  8. I have a situation where there are two collection agencies trying to collect for the same debt, each claiming they bought out the debt from the original creditor. One I have faxed validation letters to and the other is bombarding me with collection notices. I have tried to send them certified letters but the green cards never come back. How else can get in touch with these people to tell them not to contact me unless they have proof that this debt is mine? I have a phone number but they can easily say that they never talked to me.

I settled my acct w/ creditors, some just within the last week, my question is this. Can I still contact the collection agencies after settling these payments and ask that they revome the collection status from from credit report or is this too late since the settlements have been made? Thanks in advance for any answers to this or something else that might help if it is too late? April
  11. I am retired and really feel in a bad way that there is a bill out there from 1999 that I did not know about. I was unconscious from a accident and went to a hospital unconscious. They apparently got my address from my DL which had a obsolete address on it. I was removed from the hospital from my ex girl friend. I never new what hospital this bill was at or what area I was in. I found out this bill from a credit application one month ago. I have checked my creit bureau ratings in 2000 2001 and there was no report of this. I found out the phone no. of the bad marks and called which I did not handle to well with this collection agency. This bill was sent to them in 1999 and I never received a bill from them. I contacted the hospital requesting a copy of the bills after a heated talk with the collection agency. I have no problem in paying these bill, just the fact I never received a bill from anyone. I did not disappear off the face of the earth either. What approach should I use to reestablish my great credit standing seen as the guy was very addaminate at me. This is an error in their part for I have done many credit checks on myself. please advice me what to do to clean this ugly mess up. I will pay the bills but only if they clear my credit... :(
  12. I was contacted by a collection agency two weeks ago about an account that was almost ten years old. The account was written off about 8 years ago and dropped off my credit report at the end of last year. I know that the statute of limitations is up but the collector claims it does not apply since the company was unsucessfull at contacting me since I had moved. Is that true? Also, I did request validation of the debt since the collector was able to provide very little information about it, including what was purchased. They have left messages on my machine requesting a phone call since they received the validation letter. Should I call them or wait for validation in the mail? And, if they do validate the debt but the statute of limitations is up do I still have to pay? Alex
  13. I have several delinquent accounts listed on my credit report, that are due to drop off next year (7 years), but the collection agencies are also on my credit report for the same accounts, will they drop off at the same time as the original creditor, or is that a separate matter altogether.
  14. My husband and his x-wife had an account with Amex. This account was charged off and sent to a lawfirm who sued them however they were divorced at the time of the law suit, for what ever reason the judge awarded the judgment against his x-wife and are now garnishing her wadges for the account. About 6 weeks ago we got a knock at the door. well to my surprise it is a prosses server looking for my husband, and now. get this it is a summeons for the same lawfirm the same account. but this time insted of listing his x-wife, It states his name and his daughters name as husband and wife, can they sue you more than once for the same account? and whats up by listing his daughter as his wife this time. who by the way is 12 and never had anything to do with the account. and yes even though they were Divorced at the time of the judgment it still showes up on his credit report.
  15. Hi. I am being sued by a collection agency for a credit card that I got when I was first in college. They just beat the 4 year sol <I think> which they say would be June 24. Anyway I need to find an attorney or agency that deals with ths type of thing but I have had no luck. Does anyone know of an agency network or lawyer that deals with this situation or of a place where I can find one. They even had the nerve to SUE MY MOTHER even though she was never a cosigner or had a card issued in her name. They say she was supoenad and failed to respond but my mother says this is the first she heard about it. Anyway, I have the feeling they want to seize her accounts or put a lien on her house since they have since I have no assets< still in college with no house, car etc.> they have had trouble collecting from me. Can they do this? I'm thinking that I should just file for bankruptcy but I don't want them to come after my mother. If anyone can offer advice leave a reply or email me at Tutonius@cs.com.   16. I received a call today from a fellow attempting to collect a debt that the last activity was around April 1992. The original amount was about $1,000. I honestly don't remember if I paid it off or not(I had a LOT of debt, and thought that I did). They told me that with interest, charges, etc., that it was over $1,700! After arguing a few minutes(I know that is not good, but...) they said that they would take $500, but that the offer would only be good until May 30, and hinted that legal action may be taken, unless I could provide proof that I had paid the acct. I have not been able to locate ANYTHING that old(between a divorce, moves, etc.) to prove or disprove it. I have read somewhere about SOL, but am not exactly clear on where I should go from here. I have good credit now, with no negative marks, and intend to keep it that way. Any advice on where to go from here would be GREATLY appreciated. Thanks!
  17. Thank you very much for you prompt answer ;D I just want to make sure I understand this -- if the collection agency cannot prove that the debt was owed to them (as opposed to owed to the original creditor), then they can't report a collection account on my credit report? Is that correct?
