Hi, A question for my CIC friends: When a credit card issuer does not have typical retail bank operations, but is primarily an issuer of credit cards, and issues a credit card through a standard retail bank, who is the proper reporting entity listed on a credit report? For example, lets say First National Bank of Omaha (who has no retail locations) issues all credit cards for First Community Bank (who has retail locations), who is the proper party to be reporting on a credit report? Thank you.
  2. I've posted a few times on this topic and came across an interesting article and comments from a leading credit industry expert and directly from Experian on the matter tonight. I had to post this for your thoughts and comments. After receiving an IRS 1099-C form from a creditor, also known as a "Cancellation of Debt" form, there is a debate on the creditor's continued legal right to collect, and how the matter should be reported to the credit bureaus. Regardless of where you (or court opinions) stand on the issue of future debt collection, the secondary issue of credit reporting appears to handled differently by different banks. One bank may report a balance of $0 after issuing a 1099-C, while another will continue to report the full balance as still due and payable. The following article, written by credit expert John Ulzheimer, sides with the position of an account being reported as "Balance Due $0" after the issuance of a 1099-C. Even more interesting, Experian's Vice President of Public Education stated on this topic: “If the lender agrees to settle the debt for a lesser amount, the account should be reported with a zero balance because the consumer no longer owes anything to the lender. The tax burden is between the consumer and the IRS."   3. Today I received a letter for the remainder of an unpaid medical bill from National Patient Account Services (NPAS, LLC). I just checked my credit reports and the collection has not yet reported to the CRAs, and of course, I don’t want it to. I have the thirty days to dispute, etc. Should I just contact the CA to ask for a pay for deletion (under $400) or can they not report anyway because I am paying right away before the thirty days? OR, should I send the payment to the hospital and hope they accept the payment and then if it does hit my CR, dispute as previously paid? OR, should I DV them to stall it out to buy time? OR, is there a better, faster, saner way to handle this situation? My son broke his thumb and the bill was $1000 after insurance paid their portion. So, the debt is valid. I have been successful in getting my credit in working order (fako is 700) and I'd like to keep it moving in the right direction. Advice, please?
  4. Hi, I disputed an entry on my credit reports approximately four years ago and the credit bureaus all removed the entry. After ordering my updated reports this week, I see that one of the credit bureaus added a new creditor's account to my report, shown in a delinquent status. I had never heard of the party, so I looked them up online. It looks like either the party I first disputed had a name change, or they were acquired by this new party. It's hard to be 100% certain thus far, but public corporate records on file with my state show a simple name change. My question pertains to to the Fair Credit Reporting Act, Section 611, which states: (ii) Notice to consumer. If any information that has been deleted from a consumer's file pursuant to subparagraph (A) is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than 5 business days after the reinsertion or, if authorized by the consumer for that purpose, by any other means available to the agency. I never received notice of a "reinsertion." My belief is this is a reinsertion, as it shows similar account details that I disputed 4 years ago, and an alleged creditor's new name. However, the credit bureau is likely looking at as a new party, therefore a new entry is appropriate in their eyes. How would you go about disputing this, as a "reinsertion" - or......?
  5. I pulled my credit report and saw that Verizon has placed that I owe them $395 from when I left them in April 2013. It was a surprise to me; I thought I had paid them in full. I can't find records of where I did pay them, so, perhaps I do owe the money. I haven't had a blemish on my credit for a long, long time. This is the only bad thing on my report in 7 years. I don't recall owing them this much; I believe it was $325 when I closed the account and I thought I paid it. Never the less, if I'm wrong ,and I did owe them and didn't pay it, I never got any notice of it before now! I haven't moved since I closed the account either, and my phone number hasn't changed. But I digress.... Here's the situation. I called Verzon because the report on all three reports say "verizon wireless" and the status says "In collections", but it doesn't say with who. Verizon told me that it is with CBE group. I did some reading on this website before I called verizon, so I had some idea of what I was trying to gather information wise. The representative in Verizon's "collections/disputes" department told me she could no longer see any details of the account, only that I had an account and that I owed $395. She could not see why I owed this amount, could not take any payments from me, could not send me any copies of statements and could not send me anything that would validate that I owe that amount. At this point, she said, they handed it off to CBE group, and that they would handle everything from here. I called CBE group, the number she gave me. CBE group looked up my name, my ssn and the account number Verizon gave me. They can not find me. They stated they have no account for me, they show no record of ever having an account for me. How do I remove this from my report, then? I forsee the following problem. If I dispute it through the CRA's, they contact verizon - as the account is listed on my report as Verizon wireless, not CBE group, and verizon "verifies" the debt. If I dispute with CBE, they will say they don't have any record, but when I send this to the CRA, the CRA's will say, well, that's fine but the debt is from Verizon, not CBE. If I send it to verizon, verizon will say talk to CBE. It also looks like the validation letters and process are not for the orginal creditor to validate, but for collection agencies only. I don't know what to do from here. HELP!?!

Hello All, In the past I read a post either here or upon another site that Credit Bureaus use some type of method (standarized) to determine the validity of Collection agencies right to report debt. I recall it was a process that several people questioned including myself after reading how it was accomplished. I'm unable to find this info again. Can anyone point me out to this link/method/process (could not find it again via search)? Thanks in advance to everyone! Happy New Year to all!
  7. I'm trying to find the registered agent for Chase Card Services as it reports incorrect info to Equifax. According to the credit report and a fax I received from Chase Card Services, they are in Delaware (PO box). But, when I search https://delecorp.delaware.gov/tin/controller I find nothing for "Chase Card Services." Do we sue and serve JP Morgan Chase? There are only several hundred ... Or do we just serve at any Chase branch? Thanks for any pointers, Christine
  8. For the record. This is not whining. This is an attempt to motivate and point out the importance of participation. A few days ago I posted a link to the white house web site where a petition has been filed to Amend the Fair Credit Reporting Act. http://wh.gov/VA84 299 of you viewed it thus far. Forum admin signed and posted to Facebook which was wonderful. A few others of you signed it. Roughly 280+ of you read the post and did not sign the petition. If you want to effect change you have to participate in that process instead of just coming here to complain about it. If all of you singed it we would be in the 2nd rotation of getting an official response and moving it to the Sub Committee on Banking and Insurance. We have missed 280+ chances. If you want the law to work better for you, you need to help the cause. Please go to the petition site (link above). Create a log in in the White House site. (trust me they won't bother you with email or anything else) and sign the petition. Once we reach critical mass we can discuss here how best to fill it out to effect the maximum benefit for All Americans now and in the future. C'mon, Get in the game!
