  1. I am about to argue a motion to vacate a default judgement. The original complaint was filed against me without my knowledge in late 2011. The alleged date of default is from 12/5/08. I only learned about the lawsuit in April 2016, when I was sent a Notice of Wage Garnishment. I am arguing pro se. I did already object to the wage garnishment but in addition I have filed this motion to vacate. The Plaintiff (Midland Funding) and their attorney (Pressler & Pressler) sent everything from the initial 2011 complaint to the wrong address, even though I had formally changed my address with Motor Vehicle back in early 2010. The original debtor was Target National Bank. My primary defense is lack of personal jurisdiction, improper service. In addition, the city I moved to was in an entirely different county from where the lawsuit was filed. (Filed in Cumberland County, NJ and I reside in Salem County, NJ). I am hoping to win the motion without putting much emphasis on the County difference. I am comfortable with the current judge and don’t wish to change venues unless it is my only option left. Soon after I filed the Motion I received a letter from the Plaintiff's attorney asking me to prove my address from November and December 2011, when service occurred. As far as I know I already did provide proof of address change and enough documentation to show a pattern of my whereabouts during this time period. I am not sure if I should send them something right away or wait to see if the judgement is vacated? I have requested they Validate the Debt already and Pressler & Pressler refused since they had already won the default judgement. In any case, if my motion to vacate is successful, I would assume Midland Funding will attempt to refile. They might refile in Salem County this time, or attempt to restart or refile in Cumberland County. NJ Statute of Limitations on Debt Collection is 6 years. Since the original date of default on the debt is from 2008, is this debt now considered time-barred? Or is there any reason the statute of limitations would be ignored or reset? Of what issues should I be aware?
  2. Probably an easy answer I am over thinking.... have been reading posts for 7hours now and still not finding a response I am comfortable in using. PRA Summons States: #1 The plaintiff is registered and licensed to do business in New Jersey and the defendant is a resident of XXXXX County and whose social security number ends in xxx-xx-x/// is subject to this court's jurisdiction. HOW DO I RESPOND? As I see it they are combining multiple statements to somehow reel me in. I DO NOT KNOW if they are registered and licensed in New jersey since they did not provide the info to substantiate. I AM a resident in this county. They are the last 3 digits in my ss BUT this is not my debt! Any ideas here? Do I state: Defendant denies the allegations contained in Paragraph 1 of the Complaint as this request calls for admission of matter defendant has denied and thus it is improper. (Doesn't seem to address their claim of licensing etc.) Am scratching my head here!!! Also as a note, am thinking to notify court that I already opted for arb with this creditor (although they will probably just be receiving notice same day of answer is due to court) and will file a MTC to private contractual arb. Any thoughts?
  3. I had cancer when I was 20 and was on disability/SSI and almost died during this time. I had a small bill that my parents did not pay of $700(I had no income). Apparently worldwide asset purchasing opened a lawsuit for collections on this $700 when I was 23(2003). My mom signed for the paper when it was sent and I never knew about it. They didn't pursue anything however. I am now 35(2015) and out of nowhere they opened the case back up, sued me, and garnished my wages for $2000. Is this legal?? The statute of limitations is 6 years in NJ. I have a lawyer going after them for the violation of the FDCPA, but the judge wouldn't dismiss it for me based on statute of limitations because he said they are allowed to reopen that case from 2003 at any time? The judge said I could file a motion to vacate which would cost $25+ to file...is it even worth it to try to win this or should I just let them garnish the $2000 and be done with it? It isn't even on my credit report.
  4. Let's get you all caught up. Midland Funding obtained a default judgement and garnishment. That was the first time I was even aware of the action. They filed in the wrong county. I motioned to vacate default judgment - improper venue, and won. Had my garnished wages returned. The case was then transferred to the right county. Midland filed a MSJ which was granted due to an inadequacy of my response. I filed a Motion to Reconsider which was granted...vacating the MSJ and setting trial. Midland filed a Motion to Vacate....which was granted on the day of trial - essentially reinstating the MSJ as originally entered. I filed a 2nd Motion to Reconsider which was denied. My basis for the motion was that Midland never proved they had standing to sue. Me thinks that that would mean the court never did have jurisdiction in the first place. Although NJ does offer post judgment motions, given the history here - i don't think that the judge would want to hear this case again. It's time for an appeal. As you can probably figure...the budget is tight. An appeal would cost $300 just to file the Notice of Appeal and then there's the transcript costs as well. In all probability I may have to file for bankruptcy - not solely based on this, but on the totality of my financial situation. Should I just go ahead and file for bankruptcy or give it just one last shot at the appeal. I don't yet know the implications of both a judgment and a bankruptcy on my credit...but as I said, I may have to do a bankruptcy regardless. Is there any benefits of attempting to avoid the judgment as well or should I save my money for the bankruptcy filing? Your thoughts are appreciated.
  5. Hello there, everyone! Firstly, I know this is a long post to begin with, but I just wanted to thank you all for all of the information I've gained from this site just upon reading. You all are a huge help to everyone on here who takes the time to read about their case and sharing your valuable knowledge and past histories is incredibly helpful. So now, I'll get to my case. It's a very little amount, Pressler & Pressler, Midland Funding, NJ - apparently all parties are quite well known, but all details are below. Upon first receiving this, I knew not even where to begin knowing it wouldn't be worth it to hire a lawyer and assuming it's probably a debt they have little to no info on. Upon reading this site and all of your valuable knowledge, I've been able to formulate the below answer. From there, I'm lost, might even be lost with the below, but any and all comments, thoughts, questions, concerns, anything at all is greatly, greatly appreciated. 1. Who is the named plaintiff in the suit? Midland Funding LLC 2. What is the name of the law firm handling the suit? (should be listed at the top of the complaint.) Pressler & Pressler, LLP 3. How much are you being sued for? $2,108.17 4. Who is the original creditor? Credit One Bank credit card 5. How do you know you are being sued? Received Summons/Complaint 6. How were you served? Mail 7. Was the service legal as required by your state? Yes 8. What was your correspondence (if any) with the people suing you before you think you were being sued? May have spoken to on phone. May have received letters. They have my phone number listed incorrectly on the front page of the complaint (comes up for someone with the same last name who lived on the same street I did on a previous address but was not me - makes me think they lack any info?) 9. What state and county do you live in? NJ, USA 10. When is the last time you paid on this account? 8/2/2011 11. What is the SOL on the debt? 6 years in NJ 12. What is the status of your case? Suit served? Motions filed? A summons/complaint has been filed against me. I have 14 days remaining to answer. 13. I don’t trust unlisted number and thus most likely had no communication with them and this came upon me unknowingly. No I have not disputed the debt. 14.   7. Hi everyone, I am being sued by Pressler and Pressler for Midland in NJ. They filed for summary judgment but provided false information that I can easily prove is false from there own interrogatories. What should I do? File motion for dismissal with Prejudice maybe? Is this not perjury? Any help is greatly appreciated. Thanks
