  1. Need help! I am being sued by midland funding and need advice. I have no assets and I am still in school. No real source of income. 1. Who is the named plaintiff in the suit? Midland Funding LLC 2. What is the name of the law firm? Midland funding LLC 3. How much are you being sued for? $749.38 4. Who is the original creditor? Citi Bank 5. How do you know you are being sued? My parents were served with papers at home where I no longer live. 6. How were you served? In person. 7. Was the service legal as required by your state? Yes. 8. What was your correspondence (if any) with the people suing you before you think you were being sued? I receved some mail every now and then but I never answered it. 9. What state and county do you live in? Alabama, Limestone county but I live in Florida now with a Alabama drivers license. 10. When is the last time you paid on this account? (looking to establish if you are outside of the statute of limitations) It does not say on the paper and I’m not sure. 11. When did you open the account (looking to establish what card agreement may be applicable) I am not entirely sure but I think 2015. 12. What is the SOL on the debt? 3 years I think. Is this when I first opened it? 13. What is the status of your case? Suit has been served. 14. Have you disputed the debt with the credit bureaus (both the original creditor and the collection agency?) No. 15. Did you request debt validation before the suit was filed? No. 16. How long do you have to respond to the suit? 30 days I have 14 days. No questionaire. Charges are as follows: Midland is the successor to the original creditor. I made purchases using the card. I failed to make the proper payments. The card was charged off. 17. What evidence did they send with the summons? An affidavit? Statements from the OC? Contract? List anything else they attached as exhibits. see attached picture.
  2. I received a summons on Friday for a $12,000 credit card debt with Barclays. The last time I made a payment was September 2017, it’s listed on my credit as a charge off now. The first collection company was northstar, then one named LTD and then the last letter I received was sometime last year from Lloyd and McDaniel. I got tied up in this after I left my job to stay home with my first daughter years ago my husband lost his job a few months later and was unemployed for about 3 months. We are pretty much paycheck to paycheck especially with two small kids but I do have some money from our tax refund and would like to try to settle. Talked to an attorney and he said he usually can settle for about half of the amount owed but his fees would cost me about $2400 and if I make payment arrangements they’re usually for the entire amount of the original debt. There is no court date listed on my summons, just basically shows me as defendant and Barclays as plaintiff and says i have 14 days to file an answer. I have no idea what to do.
  3. Hello all that will help, Profile Recovery Associates currently owns a debt that belongs to me. The last active date of this debt is 8/12/2009. Debt total is $1,296.51 Alabama SOL is 3 years for a CC debt. They claim they purchased the debt in 2011 but it didn't appear a$$ collections on my report until 3 days ago. I don't want to make payments because then it becomes active and hurts my credit even more. i want to get it deleted but my research says this company doesn't doe PFD. Should i just give it 3 more years and it just falls of? What are my options?
  4. I lost to Midland and, although I really wanted to appeal, I decided to just take my lumps and pay. BUT I wanted to try to get the judgment vacated in return for paying. I sent a letter to the law firm that won a judgment against me asking them if they could vacate the judgment after I paid in full. They called me yesterday (2/19) said since judgment was entered on the 6th, they only have until today to vacate so I would have to get certified payment to them by today. The person I spoke with (not a lawyer) said that if I couldn't make payment by today, all they'd be able to do is file that the judgment was satisfied. I had 14 days to appeal before the judgment was entered as final so I assume this is the 14 day period they are working with to vacate. I'm also assuming that their vacation of it would me more like a dismissal. What I was asking them, in reality, was if they would file under Rule 60(b)5 - vacation of satisfied judgment. The problem I have is that I can't get the cash together and drive 2.5 hours to their offices today. I have the cash, but I have an ATM withdrawal limit and I can't get a cashier's or certified check because the closest branch of my bank is 3 hours away! I sent them a fax this morning asking if they would agree to accept debit card payment and file a motion to vacate today and if not, could we just file under Rule 60(b)5 after I had paid the judgment. I have not yet heard back. I don't think I have much choice since I can't get the money together and make the drive today. I guess if I can't get them to agree to take a debit card payment and move to vacate today, I'll just pay when I have the money together and then file a motion to vacate myself, but I'll be really disappointed if my motion fails.
  5. Ok, folks here is what we have. 1. Midland Funding is suing wife for a credit debt we don't recognize. 2. we answered the summons with deny on all accounts. 3. the amount is $1674.13 plus court costs $176 4. they only have a first and last name on the summons, so it could be anybody with the same first and last name and there appears to be several. 5. the summons only shows the last 4 digits of the account number everything else is XXXX. 6. checking one of the credit reports shows no account history, it does show "Account Type: Factoring Company Account" 7. the summons also shows the wifes previous married name, she hasn't used that name in over 6 years. 8. the SOL for Credit card debt in Alabama appears to be 3 years. researching this site shows written contracts at 6 years. 9. didn't find this site until after we sent a letter of debt validation, just to try an find out what this debt is. 10. the summons says this is a citibank credit card which she has never had. finally, her court date is July 9. I will be with her to (if possible) represent her. any advice from here on out? thanks.
