What was your correspondence (if any) with the people suing you before you think you were being sued? Gave them one settlement offer, they declined, sent paper request to stop contacting me. (looking to establish if you are outside of the statute of limitations) August, 2013 11. What is the SOL on the debt? To find out: If we use the state that I originally got the card, or the state I reside in, they are both within SOL. 12. What is the status of your case? Suit served? Motions filed? I have attended the Pre Trial denied all liability. Have a court date set in late May. They have filed a Motion to Appear Telephonically for their record keeper as well as a Motion for Summary Judgement already. 13. Have you disputed the debt with the credit bureaus (both the original creditor and the collection agency?) Yes I have disputed before with two credit bureaus. 14. Did you request debt validation before the suit was filed? Note: if you haven't sent a debt validation request, don't bother doing this now - it's too late. No 15. How long do you have to respond to the suit? (This should be in your paperwork). If you don't respond to the lawsuit notice you will lose automatically. In 99% of the cases, they will require you to answer the summons, and each point they are claiming. We need to know what the "charges" are. Please post what they are claiming. Did you receive an interrogatory (questionnaire) regarding the lawsuit? I have 10 days to respond to the motion to appear telephonically. The motion for summary judgement I plan to respond to ASAP as well. Complaint for Damages 1. Actions within the jurisdictional limits of this court 2. Defendants is/are resident of this county 3. All conditions precedent have occurred 4. Citibank, N.A. has assigned the chose in action and Plaintiff is the owner of the debt 5. Before the institution of this action Citibank N.A. and Defendant had business transactions between them and they agreed to the resulting blance for account number ending in **** 6. Citibank N.A. rendered a statement of it to the Defendant and Defendant did not object to the statement 7. Defendant owes Plaintiff 3000 on the account. 16. What evidence did they send with the summons? An affidavit? Statements from the OC? Contract? List anything else they attached as exhibits.
