Hello, i hope all is well. I'm writing this post today to ask for advice from anyone that has knowledge about or experience with JDB's or even with Unifund/Kenosian for that matter This past weekend i received this letter in the mail from Kenosian and Miele on behalf of Unifund CCR, LLC. The letter was dated 8/9/2019, today is 8/19/2019. I've been digging through the internet for as much information as possible but i still would like an experienced outside opinion as well. Should i dispute? Should i prepare myself to go to court? I haven't been summoned as of right now but i want to be proactive about this and acquire as much knowledge as possible. This is my first time encountering a JDB and i just want to make sure i'm taking the right precautions before i make any decisions. Thank you for your time. Hope someone can help.

I've read this thread http://www.creditinfocenter.com/community/topic/320964-summons-from-kenosian-and-miele-llp-attorneys-at-law-for-unifund/ and other than being confused, and looking up all the acronyms, I know I have much to learn and I want to get a start now since they haven't filed suit yet. I am possibly in a similar situation but a bit earlier than Eyoung27. Kenosian & Miele seems to be coming after me after Unifund CCR LLC had it, and there is an inquiry on my credit report by PMGI LLC which is their company from 11/2013. I'm still pretty new at credit repair as my 1st bad stint just ended up with me paying people, and a couple pay for deletes years ago. This one is a bit fresh. This is the first written contact I've had with this lawyer / collections agency. Dated 1-28-2014. They did leave me a voice mail a few days ago. I have a letter for *** NOTICE OF INTENT OF LEGAL ACTION *** --------------------------------------------- 1. Who is the named plaintiff in the suit? Unifund CCR, LLC (listed as client) 2. What is the name of the law firm handling the suit? (should be listed at the top of the complaint.) Kenosian and Miele 3. How much are you being sued for? Lists current balance due 8223.39 4. Who is the original creditor? (if not the Plaintiff) Citibank, NA : They list original acct number as 5424************ but I can't find this on my EX credit report. Could be a CC or a Citi Flex LOC 5. How do you know you are being sued? (You were served, right?) Not Sued yet, but looking at the name of the attorney, they seem to follow through. 6. How were you served? (Mail, In person, Notice on door) Not yet.... Hopefully not. 7. Was the service legal as required by your state? 8. What was your correspondence (if any) with the people suing you before you think you were being sued? N/A 10. When is the last time you paid on this account? (looking to establish if you are outside of the statute of limitations) I'm looking at a credit report I ordered from experian.com and can not find my date of default. 11. What is the SOL on the debt? I'm in California so I believe 4 years for a CC / Line of credit? 12. What is the status of your case? Suit served? Motions filed? Nothing in our San Francisco County listed in my name for a case. 13. Have you disputed the debt with the credit bureaus (both the original creditor and the collection agency?) No, I've had my head in the sand. 14. Did you request debt validation before the suit was filed? No, case not filed ... yet? 15. How long do you have to respond to the suit? (This should be in your paperwork). Intent of Legal Action 10 days from 1-28-2014 16. What evidence did they send with the summons? An affidavit? Statements from the OC? Contract? Not at this point yet.
