Attached is my rough draft of a DV letter that references the TEXAS FINANCE CODE, I've pieced it together from this and other forums examples, trying to cover all my bases so I don't end up screwing my chances of getting this collection removed. I would appreciate any advice to improve it that anyone can offer. collection.docx
  2. Hello all! This is my first time posting so I apologize if I am in the wrong place. I missed a payment because of a stupid mistake and would like to get a late payment remark removed from my account. I paid off the late payment immediately and was finally getting my credit score up past 700 because of eliminating some utilization. Of course timing is awful and this late payment happened right when I was doing well because of computer error and me failing to double check that I had all my payments in. Now my score is below 640. I want to ask your expert opinions on a goodwill letter I have constructed. From everything that I have heard, Citi is one of the worst places to deal with getting a late payment removed. Calling them provided me with no help in this matter but I did get a late fee waived without having to say anything. I originally opened my account with Zales to purchase my fiancée’s engagement ring. I am planning on purchasing our wedding bands through this account with Zales as well. The purpose of my correspondence is to see if you would be willing to give me a second chance and make a "goodwill" adjustment on the reporting of this account to the three credit agencies. I am very happy with the service that you offer and I plan to do business in the future with your company. I have high expectations of myself and I did not start off on the right foot. I missed the first payment of my account mistakenly thinking I had submitted it only to find out later that I had not. At this point I became past due of more than 30 days and a late payment mark was sent to the crediting agencies. My credit limit was also lowered after this occurrence. I know that payment was my responsibility and I am not attempting to justify this breach of my user agreement, rather I am only trying to show that this does not reflect my actual credit worthiness. I have never been late on any other accounts in any circumstance which is reflected on my credit report. I am sincerely hoping you might review the conditions under which this non-payment occurred and consider removing the negative trade line associated with this account from my three credit reports. As soon as I became aware of the balance I contacted customer service and paid the $156.00 balance in full immediately. I sincerely apologize for this action. As insurance, I have setup automatic payments to be taken from my account in the future. I am in hope to repair my credit in order to purchase a home this year and start my family. This mark is the only thing preventing me from that. I hope that Citibank is willing to work with me on erasing this mark from my credit reports. Is it too early to ask for this removal as I haven't been with them for more than a few months? I also do not have any other citi accounts as my other cards are Chase and my bank is M&T. Please let me know if anyone here has any input! Tough criticism is greatly appreciated.
  3. I recently received a letter from CA claiming I owe them around $5k. I immediately sent them a DV letter,(sample letter form from here.) They responded with, 1. original credit card application I signed, not including the agreement. Just partial copy of application. 2. All the billing statements from original creditor, Chase. That's all they sent me. Now I'm wondering if these two will be sufficient enough for them to take me to the court and win a judgement. Any thoughts??

Greetings, I won't bore you with all of the details of 7 of the 8 collection accounts I found in my credit reports when I begain this adventure on May 12, 2014 or so, but I'll include a link to a post where I'm documenting my victories one at a time here..... http://www.creditinfocenter.com/community/topic/323902-successfully-paid-3-original-creditors-in-full-but-ca-accounts-still-showing/#entry1298069 I read more than a few posts regarding the ethical duty to pay debts that are legitimate as opposed to trying to simply trying to not pay monies that we owe,.and felt compelled to pay the debts that are mine, with the exception of this last remaining collection account. Of the 8 collection accounts I started with, I have only negotiated or paid 2 CA's. I paid monies to the original creditors, as they are who I was indebted to, ethically. My last account is with Asset Acceptance. The original creditor was Beneficial. I obtained a $10,000 credit line with them back in 2006 or so. In 2007/2008, I went through business hell, began the process of trying to save my home, which failed. At that time, Beneficial was the least of my financial worries. I have no documents from Asset Acceptance. No phone calls. Disputed with the CA's. Verified. I have sent a DV letter to Asset, CMRR, but am anticipating the typical response/letter. Asset reports the account as "opened" in Aug 2010, meaning that's when THEY started reporting this account to the CRA's. The actual Beneficial credit line accout is not on any of my CRs. (thankfully) They are reporting a balance of $13,600 and it appears to grow by approximately $150 each month. I would attempt to settle this for less than the amount, and will if possible, but every posting I read regarding Asset Acceptance includes lawsuits, and motions, etc, etc. I am obviously in the waiting stages of the DV response from Asset Acceptance, but I want to be prepared for my next steps. Ideally, if I can take care of this for $2500 or so, I would be thrilled. Can anyone let me know if they have had success settling a debt with Asset Acceptance for less than the amount? Keep in mind I have not been receiving letters, phone calls or anything else from them. I'm certain I have awoken a sleeping giant, but I need to resolve this last, remaining and somewhat large collection account for employment purposes with my new job/employer. Sorry for length of post. I know that's a no-no.
  5. I received a letter from the OC in response to my DV. The letters states that the ownership of this account has been transferred. I have sent a DV letter to the company they referred me to and they did not respond and they are not on my CR, BUT the OC is still on my CR as a charge off. The account is not mine. It was my husbands, in his name only and beyond our states SOL. I am unsure of the next step I take with the OC. how do I proceed with the OC to get this account removed??? Any help will be appreciate. Thanks In advance.
  6. I have a letter for pre-approval on a debt to pay back from Midland Credit they have given me 3 options or call to set up payment plan. Should I accept this or wait for them to sue me? ;0 Thank you in advance.
  7. Hey I know there are many postings with stock settlement letters, but I just wanted to get an opinion on this one because I've read that it's almost better to make it "personal." Also, I wanted it to get through that this offer is all that I can afford. The debt is for $800. A couple of months ago I sent a PFD request for $250. They called and said they would not do PFD or even Paid in Full. They would only do settled in full. At this point, I just don't want any more open collections on my CR. She also said $250 would not be enough. So, I said I would call back after I thought over my options. Would sending this following letter suffice? I really can only afford about $350 - $400 for this. If you accept this offer, you also agree not to discuss the offer with any third-party, excluding the original creditor.
