This is my first post so please bear with me, I'm not sure how to start this. I just received a letter from Winn Law Group, a firm hired to sue me for past amount unpaid which Calvary obtained from original lender. I had contacted the original lender and let them know that I had been in an accident and lost my job. I tried to find a way to work with the lender and they refused. After depleting my entire savings I had to stop making payments. Long story short, I'm still out of work and disabled, looking at being sued and weighing out either trying to make payment arrangements or file a BK and include all my debts to wipe the slate clean. I really wanted to save my credit but it has already gone in the dumper over the past few years of delinquent accounts. I owe over 20K in card debts. Should I be afraid of Winn Law Group, try to talk to them or call it a wash and file. Thanks in advance,

I am being sued by Cavalry SPV I, LLC as assignee of Capital One Bank. Their lawyer is Winn Law Group. For $3,700.00. Since I was never served at all by mail or at home, I submitted a Motion to Quash. The company they hired to serve me stated they served a person who is about three inches taller than I am and of a different race! I have no one who fits that description who lives or has visted my house. I believe the company that was supposed to serve the papers did sewer service (which to me means they claimed they served the papers but did not). Anyway, the judge accused me of getting the papers and being the person they described in the proof of service. I was and still am really mad about that since I know I wasn't served at all. Anyway, the Motion to Quash was denied and I was given ten days to file an ANSWER. I need all the help I can get. I was hoping to submit my answer today since I have ten days to submit the ANSWER. I might have to wait until Monday If I can't figure out exactly how to fill out the form. I would appreciate any help I can get.

Need some help. I am 2 months away from the SOL of 4 years on this debt. I just received the letter on 8/1. the last payment made on the account is 10/14/2011. what should my first steps be in trying to push this out past the SOL?
