TU totally ignored one of my disputes!

I just got home from work and checked my mail and my TU results were in it.

SDSU student loan - deleted

Circuit City - New info

MTSU student loan - verified

Dept of Education - verified

3 more student loans - deleted

Cool! 3 out of 7 ain't bad!

Here's the problem: They completely ignored one of my disputes! I disputed Discover as "not mine" and it wasn't even listed on my results. It was the first one on my letter! I think I should be celebrating but I'm not sure how to go about dealing with this. Any advice would be good.

Dear Reviewers:

Over 30 days have passed since I requested you verify the inaccurate items that I have enclosed a copy of. The date of the original dispute is February 3, 2003. Since this item was not verified within the 30 days allowed and in accordance with the law (FCRA), I request that this item be removed immediately. Here is the section of FCRA that I am referencing:

(A) In general. If the completeness or accuracy of any item of information contained in a consumer's file at a consumer reporting agency is disputed by the consumer and the consumer notifies the agency directly of such dispute, the agency shall reinvestigate free of charge and record the current status of the disputed information, or delete the item from the file in accordance with paragraph (5), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer.

(5) Treatment of inaccurate or unverifiable information.

(A) In general. If, after any reinvestigation under paragraph (1) of any information disputed by a consumer, an item of the information is found to be inaccurate or incomplete or cannot be verified, the consumer reporting agency shall promptly delete that item of information from the consumer's file or modify that item of information, as appropriate, based on the results of the reinvestigation.

What I did with TU is finish all three rounds that I did with them. After they were complete I sent this letter to them. I had more in it than this, as I had already sent it once with the last dispute and they didn't even acknowledge it at all, but I had not sent copies of everything with it either. So, my experiance is to do this at a seperate time when there are no other disputes going on.

Quick question...has it been more than 30 days since you disputed? If not, they may still be waiting for a response. (i.e. it may still be 'pending' )
