Highrisk
Usually, when you get your credit report back after a dispute, it says something to the effect of "if you still think there is a problem, here are the addresses of the creditors, blah, blah, blah..." Can I ask TU to show me documents of their verification?I am on a merry go round with the creditor and TU. Letters from the creditor are apparenlty ignored by TU. The creditor says they sent the same letter to TU. Do I just wait and re-dispute? I don't think they are investigating the item each time. I think they are lazy liars. DocDon
Like kb said, you get all sorts of info back when you request they describe the procedure used in their investigation. It's their way of reminding you how powerless you really are in the scheme of things. Here's the exact law:§ 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i](6)((iii) a notice that, if requested by the consumer, a description of the procedure used to determine the accuracy and completeness of the information shall be provided to the consumer by the agency, including the business name and address of any furnisher of information contacted in connection with such information and the telephone number of such furnisher, if reasonably available;(7) Description of reinvestigation procedure. A consumer reporting agency shall provide to a consumer a description referred to in paragraph (6)((iii) by not later than 15 days after receiving a request from the consumer for that description. Highrisk
Wow! This is great! Where did you get this? I want to site it in a letter to TU. They are reporting something as "paid after charge-off/collection" and I have a letter from Household saying that they are reporting it as "paid in full." However, when TU goes to verify this with Household, apparently Household's computer is saying it was paid after it was charged-off. I happen to have a tax document from Household showing the amount of the canceled debt and the date is roughly four months after I settled on it. SHould I send this to TU? Household will no longer take my calls because I used profanity with them on two occassions. Imagine that. What do I do next? Household refuses to update their computers to reflect the accurate information. And, TU is saying I have run out of opportunities to dispute? Help? Highrisk
P.S. There is one "catch 22" in all of this. I really don't want Household to update the CRA's because when I disputed this with Equifax, it got deleted permanently. I hate to have it end up back on there. For that reason alone, am I better off not dealing with Household and just proving to the CRA's that the item is wrong? If I can get a letter showing the exact date the item was settled (which was before they cancelled the debt) and send this along with that tax form showing when it was cancelled, is this enough for TU or are they going to look at the letter and just try to verify it again with Household's damn computer? kb9tbq
So you don't want this actually updated, you want this removed. How long have you been disputing this account? You might wait a month to give a rest, since you rub them the wrong way, then come back and dispute that the account is not yours first. Try that way before you send them information showing paid.Sometimes when you start getting results back like you have, then it is just in your best interest to sit for a month or two before disputing that one again. You might even save this dispute for CHOD - like thanks giving or christmas time then they are short on time to complete their investigations. If you do send this, I would think it would work, but they should still show paid with 4 months delinquency. Paid was 120 late...Household could of fixed this for good and sent in a universal data form, the CRAs will accept these one time manual updates, but it has to come from the creditor and be faxed to them. It is just a manual one time update but that is the way they should update this.

They are reporting something as "paid after charge-off/collection" and I have a letter from Household saying that they are reporting it as "paid in full." You will definitely want to read the FCRA several time, specifically part 611. This is your main ammunition in trying to get the CRAs to comply. It doesn't mean they will, but you do have rights. That is why it is important for you to read several times over this part of the FCRA, and the rest of the FCRA when you have time. You won't be given your rights, you have to fight for them...sometimes legally, which is where I am at now.
