SOL question...

The SOL for Georgia is 4 years for open end or non-contract type accounts. I had interenet service that began in MArch of 1999. The service sucked, so after about 7-9 days I called and cancelled. Now that I am looking at my report, they are showing a collection $120.

I actually called the CA (because I know personally the person who owns it). They received the printout today that said the service was on from 03-99 to 12-99 with NO PAYMENT ever made on the account.

First, doesn't it seem strange that they would let an account stay on that they never EVER received a payment on?

Second, where or what date would the time for the SOL begin?

BTW, they do not show a record of my calling and cancelling, but I do have records of other internet service I had during that same period....the guy from the CA said "so what"...I told him, "yeah I'd have two services on at the same time"!!!!

Any help is greatly appreciated.

If you never paid, that would mean that the SOL begins on the date of your first delinquency (the date when payment was due and you did not submit a payment), which would be 04/99. I'm not sure if internet service falls under open end category, but if you're right and it does, then you should be OK. Regardless, I doubt that they're going to sue you over a $120 collection.

Whether or not the legal SOL has run out, the reporting period won't run out until 2006. So, you need to DV the CA (statement printouts aren't enough), then dispute it with the CRAs. How is the tradeline showing on your CR? Did the OC reported it as a chargeoff and a CA reports it as collection? If yes, dispute both as not mine. Wait and see what happens. If it doesn't work, dispute account closed date as 03/99, etc, etc.
