If I DV them and they cannot prove, what do I do? I've been reading and re-reading all info on the DV site above, but I theres no info about DVing an OC. Pale Rider Posted July 19, 2003 Report Share Posted July 19, 2003 Did they purchase the account before or after it went into default?Normally the OC is not subject to FDCPA, only a CA or anyone who received the account after it was in default. If the account was not in default, but there is a dispute, you can use Fair Credit Billing Act (FCBA), but it requires you to dispute within 60 days of first bill with error.Now, you could send DV to OC and maybe they don't know they are subject to FDCPA.
