mpk
Hi, does anyone know if a BK will erase a Judgement for a Credit Card? I know that judgement will stay on CR, but I wanted to know if I would still have to pay the credit card company if they get a judgement before I file. sisflomi
The bk will null and void the judgment, then you can ask your lawyer to vacate the judgment for you, that should help get it off your reports.
mpk
um, can you explain that a little more? How is it possible to get rid of a judgement (from paying it that is) and then get BK off my credit report? I'm considering BK but I'm really scared to do it. Mainly, I don't know what employers will think about it for the next 7 years if they check it.

Then your lawyer could file a paper with the court called motion to vacate. The judgment would no longer exisit if that happens and you could get it off your reports. If you paid it, then you need a satisfied letter from the courts. The holder of the judgment should have sent this to the court house. Your report would show satisfied. You can always dispute the judment as not mine to the cra and see if it comes off.Bk is nothing to be afraid of, if your honest and tell the lawyer everything, you will be fine. Some employers I am sure are not happy about that. But unless they pull a credit report they wouldnt know about it. They cant ask you questions like that to determine if you can be hired or not. They can ask to pull your report though. ghacorp
You would have to decide which is worse, bad credit or a bankruptcy filing. Typically, bankruptcy filings last indefinately with respect to people being able to find out, however 7 - 10 years with credit reporting agencies. Consider filing 13 if it works for you because it shows you're willing to pay back what you can.
Lori M.
Hello, are you guys saying that judgements are taken off automatically when you file BK? Do the creditors have anything to say about that? Can they fight it and say "No, we want to be paid regardless of Chapetr 7"? Or does everyone you enter as part of your BK (including Judgements) have to accept that they are screwed? I am just starting BK right now and have 2 judgements against me and garnishments. I'm gonna cancel it if I'm not guaranteed to have a fresh start. After all, what's the point in BK if I still got judgement and garnishments. A creditor took him to court, got garnisment. Half of garnisment came out during the bk filing. Creditor was made to pay back the garnisment. Lawyer has to file a motion to vacate the judment now that bk is over. BK does include judgments, but not all, like if you were drunk driving and got took to court it would not be discharged, if you owe child support it would not be discharged. If you owed citi bank 5000 from a judgment and it was not from fraud, it would be discharged. Again, the lawyer has to make a motion to vacate the judgement.
