tolstoy
Yes, they are required to validate if it appears on your credit report. This goes for good, bad, paid and unpaid listings.Anything that appears on your credit report must be accurate and, therefore, is subject to a validation request.Have you tried just running a dispute as "Not Mine" to the CRAs? Many times, a CA won't bother to resond to a verification request on a paid collection.
chuckd
I have a paid medical collection, $31, on my credit report. I paid it over a year ago before I knew that I could request validation and foolishly took their word that it would be deleted. They didn't delete it of course so I sent a couple letters requesting them to fulfill their end of the deal. No such luck. So the past couple months I have been requesting validation, in the hopes that they don't have any and if not then I could the the CRA's to delete. I have requested validation twice, via certified mail, and each time stated that my payment was not an admission that the debt was mine, that it was such a small amount of money so I paid it to quickly resolve the matter. They continue to ignore my validation requests. I wrote 2 letters to Equifax explaining the whole situation and included all correspondance to the CA along with the green cards, they won't remove it. I was going to send a nutcase letter to the CA but now I am wondering if they even are obligated to validate a paid collection. Do collection agencies have to validate a debt that has been paid? Thanks!Short answer: YESLong answer: Yes MA'AM! They have to be able to validate the debt to have any type of collection activity occur (this includes reporting to the CRAs per FTC opinion). Also, dispute with the CRAs and if it comes back verified send them a letter asking how it is possible for the CRA to verify if the CA cannot validate the debt is in fact yours.Have you tried disputing with the CRAs? I had a $284 paid collection that was removed thru an online dispute with TransunionAnd you get a free copy of your report Good luck!
chuckd
what the heck is up with the formatting of the threads? I just replied to this thread and the post I replied to is now showing BELOW my reply?Whazzup?!?!?
StacyKatt
I had to create another account b/c it wouldn't let me respond to the thread. I think it's because the replies are going up instead of down, if that makes sense lol. But what I was going to say....I have disputed it as not mine several times and did ask how they are able to verify if the CA won't validate, no luck. After my 2nd dispute, the CA even started to report this account twice on my report. They ignored all my demands to remove even one of the entries. Finally a call to the CRA resolved that. They just keep racking up violations. I disputed it again as not mine 2 days ago and just sent out a nutcase letter to the CA today. Hopefully this time they will take me seriously, if not, I will file complaints, I've had enough. I can't believe they are being so stubborn and disregarding of the law for a 6 year old, $31 paid collection!::EDIT:: Chuck....I just disputed a $1300 unpaid collection as not mine with TU and it was deleted, they even deleted a $4000 several months ago, I love them lol.
