How to sue Transunion?

I successfully got a judgement vacated in June. The paper that the court sent to me explaining the judgement was stricken was copied and sent to all credit bureaus. The only one that will not remove this judgement is Transunion. After I sent them the court document they would not accept that. Next I disputed and it came back validated, which cannot be true since I received the letter from the court stating it was stricken.

I called and complained the other day and opened a new investigation (dispute)...Received letter today saying it is frivolous. What should be my next move? Can I sue them now? Please someone make it stop! Make it stop!!!

Yes you can. And I hope you stick them with the maximum penalty allowed. There's a couple people here who have successfully taken on the big dogs. They'll give you some concrete guidance. We've got some great lawyers on this board too that can give you some insight.

Well, I won't touch the nuts and bolts of your case, because I'm just not "up there" in terms of the knowledge to give you the really sound advice, but I do know HOW you sue TransUnion.. just got done doing it myself(and got paid, woot). You have to find their "registered agent" in your state, then run down to the courthouse and file a claim against them.. make sure you don't just mark the "big" violations you have them on(i.e. FCRA). Each state apparently has a "Consumer Protections Act" that entitles you to treble the damages, and lot of states have other little things that let you increase the bottom line. List EVERYTHING you want to sue them for(statute wise) on the thing for the suit--don't forget to include "And all court/legal expenses"...you can't add to those suits later after you file them, and the clerk can't give you advice and point out to you that you should include that.

Anyhow, do all of that, pay the money, wait for them to get served. The sheriff's department will call you with a court date, then you either wait for their attorney to call you, or wait for your day in court :). I'm guessing in your instance, much like mine, they'll call you and offer you money. This is where demanding every last nickel in your suit comes in handy, because that's the number you come down from in negotiations.

And one thing that I found out(and would have screwed up had not a friendly attorney been in the clerk's office when I was filing my suit), make sure you get their name down EXACTLY as it's supposed to be. I had originall just put "TransUnion" as the defendant... it would have been thrown out if I had filed it that way, because it had to read "TransUnion, LLC"

Thanks for the advice and info...I have a chapt 13 BK and two creditors went ahead and sued me in small claims. Well, they were already listed in my bankruptcy so I placed a motion in court to have the judgment vacated. Went to court, showed the judge my bankruptcy papers, showing those two creditors listed in my papers...He vacated them. I sent all CRAs a copy of the court documents, but transunion say they do not accept that court document and they must investigate. Well, they investigated and it came back verified. Impossible! Tried to dispute again last week, received letter this week saying it was a frivolous request. Time to get on the ball and fight back!

i know what you mean transunion wont investagate my providian account even know i have asked them 3 times to investigate it just need someone to help me sue them for failure to investigate in 30 days i live in wa state

hmm guess i need to work on experian via getting a judgement vacated due to my bk

I am now planning on filing a lawsuit against TU in small claims. I asked for their local address or even for one in the state and they said they have no offices there. She gave me their corporate address in PA.

They have a "registered agent" in every state. Calalawyer gave me a link one day that gave you those addresses, but I lost it :(. See if you can't butter him up to provide it again :)
