It is a violation of both sections 804 and 806 of the FDCPA.They are allowed to call a 3rd party ONCE to aquire location/contact info. Once they HAVE that, using your neighbors as a messenger service is NOT allowed !!If you want to make them stop, send them a modified Cease and Desist and tell them they are to contact you ONLY BY MAIL - no phone calls to you or ANY 3rd party. ghacorp Posted July 26, 2003 Report Share Posted July 26, 2003 They probably DO know all they need to know about you, however if a few phone calls to neighbors as a ruse to get you to call them back or to embarass you does the trick, then it's worth it to them. Most people aren't familiar with FDCPA laws so most collectors get away with stuff like that. If NOT what can I do to stop it?Thank you! in agreement with my counter part. it is allowed depending on how much location information they are lacking. yet only allowed once. a cease will definitely stop it, but let me share a little story with you if your ever interested in paying the matter. i have people who have ceased me after offering me a horrifically low sif amount i wasnt auth to take. then the client later gave us across the board, very low sif piramter for one month only on all their accounts. it would have been lower than what i wasn't authorized to take before! ...legally i couldnt call to advise.
