Even if the so-called "validation" was not proper I am curious how long it takes for those that got something back.Was it less than a month? 1 month? 2 months? 3 months? Never? kb9tbq Posted July 28, 2003 Report Share Posted July 28, 2003 See what you think is generally granted by the FDCPA apon first discovering you have of a collection (1st communication from the collection company) you are alotted 30 days:§ 809. Validation of debts [15 USC 1692g](a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing -- (5) a statement that, upon the consumer's written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor. http://www.creditinfocenter.com/legal/FDCPA.shtml#809But this is worded specifically regarding 1st communication of debt, after this point you are looking at trial & error to get the collection agencies compliance to validate. Some will respond some won't, and how they respond will differ from one to the next.If you don't hear back in 30 days, then you follow up with a 15 day notice. Then from there - your guess is as good as mine, some try esstopal letters, nutcase letter... But if you read the FDCPA especially 809 you should see what I mean about 1st communication being the only time mentioned that the collection agency legally is suppose to comply with DV Letter request.
