lizandjerry Posted July 29, 2003 Report Share Posted July 29, 2003 I agreed to a settlement with a CA collecting for citicard about 2 months ago. I only have 1 more payment left and the settlement agreement is complete. However, yesterday I received a statement from the OC. It was just a regular statement showing my payments, my account number, the current balance, etc. Just a regular statement. I haven't received statements in them for months and months (at least since the CA took over the account). Why would they be sending me this info? Anyone have this happen to them before? I'm wondering if they're trying to take back the account since the CA got me to pay. Any ideas? Link to comment Share on other sites More sharing options...
katy Posted July 29, 2003 Report Share Posted July 29, 2003 i'm not a credit expert, but for what it's worth, here are my two cents.the exact same thing happened to me - i called the collection agency asking why i was receiving statements with a balance from the O.C. and they told me it was because they had not updated the system yet. yeah, right. what they REALLY did {the collection agency} was sell the remainder of the settlement balance (which should be appearing on the balance from the O.C.) to ANOTHER credit card company (I ended up with citibank) and then they started claiming that i need to pay the remainder balance. So the settlement balance from my account was $300 and ended up jumping to $800 with interest and fees. I sent D.V. letters to 'citibank' - got that off - and sent one to the O.C. and they stopped sending them. kb9tbq Posted July 29, 2003 Report Share Posted July 29, 2003 Don't like the sounds of that one, boy - they go too far.Call the OC and get an explaination from them as to what they think they are up to in this matter,My first thought was as to how delinquent you had become prior to the collection agency making payment arrangements with you. Cause if you are under charge off within 6 months you might be able to reabilitate the account and carry on your relationship with the creditor, if the account has not been closed on you.But don't take chances find out where they are standing on this, and fight for your rights in this matter should they try to pull any tricks on you.Remember you can file complaint with the BBB, FTC, Attorney General and such about your case should you find out this is the case. The only difference is that Citicard was my OC. I just looked at the settlement from the CA and the statement that Citicard sent and it appears that they are doing exactly what you said. I still have one more payment to the CA (So far I paid $444.00. Initial balance to the OC was 3646.48 and the CA settled for $729.30. The statement from the OC shows the recent $243.00 paid transaction and a new balance of $3202.24 (the difference after the $444.00 payment.) So you guys think I should really call the OC reguarding this? I cant believe they are doing this since I still have 1 more payment for the settlement. I thought that in order for the OC to come after you for the remainder, that they have to write something in the original agreement that would allow them to do so. I mean, I've heard of the OC coming after you eventually, but while you're still paying off the CA? That's a little overboard. Thanks again for the advice.
