Im trying to understand the SOL, but Im kinda of confused to how it works. ADSOFT
Okay, Found some info on the internet. So some my collections that im paying now (by the way are over 4 years old), i really didnt have to pay them??Ask Texas lawyer; I heard something about the SOL on written contracts can be renewed. In most states after the sol you don't have to pay, just send a C/D letter stateing the SOL is up. If they sue you and win on a SOL contract you can counter sue.
Pale Rider
Here is a link to the Texas SOL statuteshttp://www.capitol.state.tx.us/statutes/ci/ci0001600toc.htmlNot sure if this section would apply to your situation§ 16.065. Acknowledgment of ClaimAn acknowledgment of the justness of a claim that appears to be barred by limitations is not admissible in evidence to defeat the law of limitations if made after the time that the claim is due unless the acknowledgment is in writing and is signed by the party to be charged.
